Özet

Yükseköğretim kurumlarında, kısmi zamanlı statüde birçok öğrenci çalıştırılmaktadır. Bu çalışma esnek çalışma biçimlerinden biridir. Öğrenciler bu çalışmayla, deneyim kazanmakta, belirli bir gelir etmekte ve üniversiteler de bazı işler için bu yoldan personel ihtiyacını karşılamaktadırlar. Yükseköğretim kurumlarında öğrencilerin bu biçimde çalıştırılması genelde kabul gören bir uygulama olmuştur. Ancak bu çalışma biçimi kabul edilirken, üniversite öğrencilerinin özlük hakları, ücret ve diğer çalışma koşulları ve soysal sigorta hakları beklentilerin altında kalmıştır. Üniversitelerde kısmi süreli statüde çalıştırılan bu öğrenciler, İş Kanunu bakımından işçi kabul edilmemişler, ancak Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu bakımından kısmen sigortalı sayılmışlardır. Çalışmamızda, 2547 sayılı Yükseköğretim Kanunu, 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu ve Yükseköğretim Kurumları Kısmi Zamanlı Öğrenci Çalıştırma Usul ve Esasları hükümleri göz önünde bulundurularak, kısmi zamanlı öğrencilerin, çalışma ilişkileri, ücret, işe yerleştirme, sosyal sigorta hakları ve sosyal sigorta işlemleri üzerinde durulmuştur.

Abstract

Many students work on a part time basis at the Institutions of Higher Education. This type of employment is one of the flexible types of employment methods. This type of employment enables students to gain experience, andearn a certain amount of money; and it provides staff for the universities for certain kinds of jobs. This type of student employment at the Institutions of Higher Education has been widely acclaimed. Even so, employee benefits, salaries, and other work conditions of the university students, and their social security benefits fall behind expectations. These students who are employed on a part-time basis, are not considered to be workers under the Labor Law; however, they are partially insured by the Social Security Administration, and under the Law of Health Insurance. This paper elaborates upon work relations, salaries, job placement, social security benefits, and social security procedures of the part-time student employees based on the 2547 numbered Law of Higher Education, 5510 numbered Social Security, and Health Insurance Law, and the Procedures, and Principles of thepart time student employment at the Institutions of Higher Education.
