Özet

İş hukuku devamlı surette gelişime açık ve değişken bir yapıya sahip olduğu için, zamanla iş sözleşmelerinde değişiklik yapılması gerekmekte ve iş sözleşmesinin değişen şartlara uyarlanması gerekmektedir.4857 sayılı İş kanunun 22.maddesinde düzenlenen işçinin çalışma koşullarında esaslı değişiklik yapmak isteyen bir işveren, bu değişikliği ancak işçiye yazılı olarak teklifte bulunmak ve işçinin de altı iş günü içinde vereceği yazılı rızası ile gerçekleştirebilir. İşçinin yazılı rızası olmadan yapılan esaslı değişiklikler kanun hükmüne aykırı olduğundan bir hüküm ifade etmez.Ancak işçi lehine yapılan değişiklikleri işçinin kabul etmemesi iyi niyet ve dürüstlük kurallarına aykırı olduğundan işçinin lehine olan değişiklikleri kabul etmesi gerekir..İşveren yönetim hakkı kapsamında kalan ve esaslı nitelik taşımayan değişiklikleri ise yapabilir.İş güvencesine sahip olan İşçi çalışma şartlarında esaslı değişiklik önerisini altı iş günü içerisinde kabul etmez ise işveren feshin geçerli nedene dayandığını belirterek ihbar önellerine uyarak iş sözleşmesini sona erdirme hakkına sahiptir.Bu durumda İşçi feshe karşı 18 ile 21.madde hükümlerine göre işverene dava açarak feshin geçersizliğini ve işe iadesini talep etme hakkına sahiptir.Dava sonunda feshin geçersizliğine karar verilmesi halinde ise işveren ya işçiyi işe tekrar başlatacak ya da şartları varsa işçinin tazminatlarını ödeyecektir.

Abstract

Since labor law is open to constant improvement, and since it has a variable structure, employment agreements need to be amended over time, and an employment agreement need to be adjusted to the changed conditions. An employer who wants to materially change the work conditions of an employee- regulated under Article 22 of the 4857 numbered Labor Law, may only implement this change by a written proposal to the employee, and a written consent submitted by the employee within six business days. Material changes that are implemented without the written consent of the employee are void, since they are against the law. However, if the employee does not give consent to the changes that would benefit the employee, and since this would be against the rules of good faith and fair dealing, an employee should accept the changes that would benefit him/her. On the other hand, an employer may make non-material changes that are within the scope of right to govern. If an employee who has job security, does not agree on the offer of material changes in employee work conditions within six work days, indicating that it is based on a valid reason, an employer has the right to terminate the employment agreement, abiding by the notice date. Then, under the provisions of articles 18, and 21 an employee has the right to initiate a lawsuit against the employer claiming the invalidity of the rescission, and requesting reemployment. At the end of the lawsuit if the Court decides that the rescission is invalid, the employer shall either reemploy the employee, or pay the he employee's damages, if he/she has a request for such damages.
