Özet

Her insan, günlük hayatında dilediği kıyafeti giyme ve dilediği bi-çimde görünme özgürlüğüne sahiptir. Kişi, dış görünüşüyle sadece bir ihtiyacını karşılamaz, aynı zamanda ruh halini, ideolojisini ve genel ola-rak kendisini ifade eder. Toplumsal yaşamın bir parçası olan çalışma ilişkilerinde de kılık kıyafetin önemi büyüktür. Uygulamada kılık kıyafe-tin çalışanların işe alınmaları, iş ilişkilerinin devamı ve sona ermesinde etkili olduğu görülmektedir. Kılık kıyafet konusunda çıkan uyuşmazlık-larda, işverenin yönetim hakkı, işin, işyerinin ve işletmenin gerekleri, iş sağlığı ve güvenliği, sözleşme serbestisi, işçinin kişilik hakları, temel hak ve özgürlükleri dikkate alınarak kılık kıyafetin iş sözleşmesinin fes-hini gerektirecek haklı veya geçerli bir neden olup olmadığı her somut olay bakımından ayrı ayrı değerlendirilmelidir.

Abstract

Every individual has the freedom to wear whatever he/she wishes and to appear in any way in his/her daily life. With his/her appearance, the individual does not only meet his/her needs, but also expresses his/her mood, ideology, and himself/herself in general. The clothing and appearance are also important in employment relationship which is a substantial part of the social life. In practice, it is observed that clothing and appearance play an effective role in the process of recruitment, con-tinuation, and termination of the employment. In disputes relating the clothing and the appearance, whether the clothing or appearance of a worker is a valid reason or just a cause for the termination of the labour contract should be evaluated separately for each concrete case. In this evaluation, employer’s right to manage, requirements of the work, workplace and enterprise, occupational health and safety, freedom of contract, employee's personal rights, fundamental rights and freedoms should be taken into account.
