Özet

Özgürlük ve hak kavramlarının, öğretide, yargı kararlarında hatta kimi zaman pozitif hukuk metinlerinde birbirlerinin yerine kullanıldığı görülmektedir. Bu durum “sendika özgürlüğü” ve “sendika hakkı” kav-ramları için de böyledir. Öğretide kimi zaman sendika özgürlüğü, kimi zaman sendika hakkı kavramları kullanılmakta, bazen de sendika özgür-lüğü ve hakkı veya sendika özgürlüğü (hakkı) şeklindeki ifadeler tercih edilmektedir. Özgürlük ve hak kavramları bu şekilde aynı anlamda kul-lanılsa da, anılan kavramlar birbirlerinden farklıdır. Bunların aynı anla-ma gelecek şekilde kullanılması dilin gereken özen gösterilmemesinden kaynaklanmaktadır. Bu nedenle sendika özgürlüğü ve sendika hakkı kavramlarından hangisinin kullanılacağının belirlenmesi teorik açıdan önemlidir.

Abstract

It is seen that the notions of freedom and right are used in the sa-me conception in the doctrine, judicial decisions and sometimes even in the positive legal texts. This is also the case for “trade union freedom” and “right to organise”. In the doctrine, it is sometimes seen that the expressions of the trade union freedom and the right to organise substi-tute each other. Although the notions of liberty and right are used in the same way, these two notions are different from each other. The use of these words in the same manner is due to the fact that the language is not used with the utmost care. For this reason, it is theoretically impor-tant to determine of which expression will be used, “the trade union fre-edom” or “the right to organise”
