Özet
İşveren tarafından yapılan görevlendirme ile başka bir yere gönde-rilen sigortalının asıl işini yapmaksızın geçen zamanlarda uğradığı kaza iş kazası olarak kabul edilmektedir. Sigortalının görevlendirme nedeni-nin yaptığı asıl iş olması veya kazaya uğradığı sırada görevlendirildiği işle ilgileniyor olması şart değildir. Görevli bulunduğu zaman boyunca normal yaşantı içerisinde ve dürüstlük kuralları çerçevesinde olmak ko-şuluyla başka işlerle ilgilenebilir. Aranan temel unsur işverence görev-lendirilmiş olmasıdır.
Abstract
The accident that the person with social insurance has had, who has been sent to another place by the employer with an assignment, when he/she does not do his/her main job, is considered as a work accident. It is not required that the main reason for the assignment of the insured person is his/her main job or the person performs his/her job to which he/she was assigned, during the accident occurred. The person with social insurance can perform other tasks in his/her daily life during his/her assignment, provided that it is within the framework of good faith. The main point here is that the insured person is assigned by the employer.
