Özet

Toplu iş sözleşmesi yapmak isteyen işçi sendikası, Bakanlığa başvurarak yetkili olduğunun tespitini ister. Bakanlık, kayıtlarına göre başvuru tarihi itibarıyla bir işçi sendikasının yetkili olduğunu tespit ettiğinde, bir başka deyişle olumlu yetki tespitinde bulunduğunda başvuruyu, işyeri veya işletmedeki işçi ve üye sayısını, o işkolunda kurulu işçi sendikaları ile taraf olacak işveren sendikası veya sendika üyesi olmayan işverene bildirir. İşçi sendikasının yetki şartlarına sahip olmadığının ya da işyerinde yetki şartlarına sahip bir işçi sendikasının bulunmadığının tespiti hâlinde, daha açık deyişle Bakanlık olumsuz yetki tespitinde bulunduğunda bu bilgiler, sadece başvuruyu yapan tarafa bildirilir. Bakanlığın olumlu veya olumsuz yetki tespit yazısını alan ilgililerin, yetki tespitine itiraz etme hakkı bulunmaktadır. Çalışmamızda 696 sayılı Olağanüstü Hal Kararnamesi kapsamında sürekli işçi kadrosuna geçirilen işçilerin bulunduğu bir işyeri için Bakanlık tarafından yapılan olumlu ve olumsuz yetki tespitine itirazlar, Yargıtay kararı doğrultusunda incelenecektir.

Abstract

A labour union that wants to sign a collective labour agreement is required to demand the determination of its authority by the Ministry. When the Ministry determines that the labour union is authorized to sign the aforementioned agreement, as of the date of application according to its records, in other words, when it determines a positive authorization, the Ministry notifies the labour unions active in that sector and the emp-loyer’s union which will be party to the collective labour agreement or the employer when it is not a member of a employer’s union regarding the application, the number of workers and union members in the workp-lace or enterprise. Following the application when it is determined that the applicant labour union does not fulfill the authorization require-ments or that there is not a labour union at the workplace which fulfills the authorization requirements, more precisely, when the Ministry de-termines a negative authorization, this outcome will only be notified to the applicant party. Those concerned who receive the Ministry's positive or negative authorization notice have the right to oppose to the same. In our study, oppositions to the Ministry’s decision regarding the determi-nation of positive or negative authorization, in relation to a workplace employing permanent workers which attain the permanent worker status via Decree No. 696 will be examined in light of the decision of the Sup-reme Court.
