KAT MÜLKİYETİNE 5711 SAYILI KANUN İLE GETİRİLEN YENİLİKLER

Özet

Konut ihtiyacı, insanlığın var oluşundan bu yana devam eden zorunlu insanî bir ihtiyaçtır. Bu nedenle ülkemizde 634 Sayılı Kat Mülkiyeti Kanunu (KMK), bu anlamda özel olarak düzenlenmiş ve taşınmaz mülkiyetinin özel bir türü olarak kabul edilmiştir. Günümüze değin bu kanunda yapılan değişiklerle hukukî sorunlar giderilmeye çalışılmış; ancak her zaman günün koşullarına cevap verememiştir. Bu nedenle kat mülkiyeti kanununda mutat seferler değişikliğe gidilmiştir. 5711 sayılı Kanunla değişikler çözüm noktasında büyük fayda sağlamıştır. Bu çalışmada 5711 sayılı Kanunla getirilen değişiklikler ve yenilikler incelenmiştir.

Abstract

The need for housing is a compulsory humanitarian need that has continued since the time of mankind's existence. For this reason, in our country, the Law on the Property of Condominiums No. 634 has been specially regulated in this sense and accepted as a special type of immovable property. The legal problems have been tried to be solved with the changes made in this code. But has not always responded to the conditions of the day. For this reason, the floor ownership law has been amended several times. The amendments to Law No. 5711 have been of great benefit in solving some legal problems. In this study, the changes and innovations brought about by Law No. 5711 were examined.
