MÜLKİYET HAKKININ ARANMASINDA ZAMAN VE MALİYET ANALİZİ: TESİS KADASTROSU ÖRNEĞİ

TIME AND COST ANALYSIS IN SEARCH OF PROPERTY RIGHTS: A CASE STUDY ON BASE CADASTRE

Özet

Ülkemiz genelinde tesis kadastrosu çalışmaları 2005 yılında Ka-dastro Kanunu’nda yapılan değişikle özel sektörün iş gücünden faydala-narak Tapu ve Kadastro Genel Müdürlüğü kontrolünde yürütülmektedir.Tesis kadastro çalışmaları tamamlanırken kadastro çalışma alanında olantaşınmazların Kadastro kanunu ve artçı mevzuat uyarınca tespit ve tescil-leri yapılmaktadır. Ülkemizde vakıf taşınmazların yönetim ve temsilin-den sorumlu olan Vakıflar Genel Müdürlüğü, yapılan tesis kadastrosuçalışmalarını vakıf taşınmazlarla ilgili süreçleri yönetme amacıyla takipetmektedir. Bu süreçte, vakıf aleyhine olduğu düşünülen durumlarda vakıfların haklarının korunması için gerekli işlemleri yürütmektedir. Busüreçlerde zaman ve maliyet bakımından yapılacak olan irdelemeler ça-lışmanın temelini oluşturmuştur. Böylece; vakıf taşınmazlar sayesinde,bu davalar için harcanan maddi kaynaklar ve zaman, çalışma kapsamın-da ele alınmıştır. Çalışmada örneklem olarak Artvin İli Ardanuç İlçesin-de bulunan mazbut vakıflara ait taşınmazlar ele alınmıştır. Bu taşınmaz-lardan, 2005-2015 yılları arasında yürütülen tesis kadastrosu çalışmalarısonucunda mahkemelere intikal etmiş ve dava konusu edilmiş olan dos-yalar incelenmiştir. Çalışmanın en önemli sonuçlarından biri; kadastrokaynaklı, açılan davaların ortalama 32 ayda tamamlandığı ve 736 TLmaddi külfet ile davaların sonuçlandığı belirlenmiştir.

Abstract

In the whole of our country, the cadastral works were carried out under the control of the General Directorate of Land Registry and Ca- dastre, taking the advantage of the private sector according to the Ca- dastre Law which was changed in 2005. Cadastral works were comple- ted, the immovable which are in cadastre study area are determined and registered according to cadastral law and the sub-legislation. The Gene- ral Directorate of Foundations (GDF), which is responsible for the ma- nagement and representation of the foundation properties in our co- untry, follows the work of the cadastre to manage the processes related to the foundation and their immovable. In this process, the foundations via GDF are carrying out the necessary procedures for the protection of the rights of the foundations in cases which are considered to be against it. In these processes, Investigations to be done about time and cost is the basis of the study. So; thanks to the foundation's immovable proper- ties in the court process, the money spent and the time consuming have been taken into consideration. In the study, the immovable belonging to fused foundations in the province of Artvin Province Ardanuç District were discussed. From these immovable, as a result of the work of the cadastre works carried out between 2005 and 2015, the cases which were brought to court were examined. One of the most important results of the study is cadastral cases are completed in average 32 months and the cases average amount is 736 Turkish Liras.
