Özet

İdare mahkemelerinin önüne son zamanlarda gelen bir uyuşmazlık yargı camiasında derin bir tartışmayı da beraberinde getirmiştir. Yasama meclisi tarafından kabul edilen bir çok yasa maddesinin içeriğinde artık kamu görevlilerinin belirli şartları taşımaları halinde ikinci bir idari iş- leme gerek kalmaksızın görevlerinden alınmalarını konu edinmiştir. Di- ğer bir değişle bir çok yasal düzenlemede idari işlem mahiyetinde hü- kümlere yer verilmiş ve kapsamda bulunan kamu görevlilerinin yasa maddesinin yayımlanması ile birlikte görevlerinin sona ereceği hükme bağlanmıştır. Bu şekilde görevi sona eren personel tarafından idare mahkemelerinde açılan davalarda çeşitli tartışmalar yapılmış, uyuşmazlıklar değişik kararlar ile sonuçlanmış olmakla birlikte bir çok mahkeme tarafından bu tür uyuşmazlıkların kamu görevlisinin görevine son veren hususun kanun hükmü olduğu ve ortada bir idari makam tarafından tesis edilmiş klasik manada bir idari işlem olmadığı gerekçesi ile uyuşmazlıkta idari yargıya konu edilebilecek mahiyette bir idari işlem olmadığı gerekçesi ile bakılan davalar usulden incelenmeksizin ret kararları ile sonuçlandırılmaktadır. Yapılan çalışmada, konu maddi ya da şekli nitelikte yasa tartışması şeklinde ele alınmaktan ziyade yasama meclisinde kabul edilen ve kamu görevlileri hakkında doğrudan ve subjektif nitelikte madde hükmü içeren, birey hakkında doğrudan uygumla imkanı bulunan ve idari nitelikte sonuçlar veren tasarrufun bir iptal davasına konu edilmesi ve bu hususun Anayasa ve uluslararası hukukta güvence altına alınan hak arama özgürlüğü ve mahkemeye ulaşma hakkı diğer bir değişle onun doğal bir tezahürü olan adil yargılanma hakkı bağlamında incelenerek, uygulamaya ilişkin tespit, analiz ve önerilere yer verilmeye çalışılmaktadır.

Abstract

A dispute brought to the administrative courts recently has caused a deep discussion in the judiciary. Many laws enacted by the legislative body constitute dismissals of government officials without subsequent administrative actions under particular circumstances. In other words, a good many legislative acts include provisions in the nature of administrative actions and require the dismissals of the government official concerned following the promulgation thereof. The government officials subject to such regulations have brought cases to the administrative courts and those cases raise disputes in the courts. Those disputes have been concluded in various ways. A great number of the courts have dismissed the cases because of the fact that there is no administrative actions which may be subject to judicial review of the administrative courts. Rather, according to the rulings of the courts, the disputes arise directly from the legislative acts that are not subject to the judicial review. In this article, the discussion on the different features of substantial law and procedural law will not be addressed. Instead, we will put our focus on the provisions of the law requiring automatic dismissal of the government officials and judicial review of those actions along with the right to legal remedies, access to justice and the right to fair trial which are safeguarded by the constitution and international law. To do so, we will give place to some determinations, analysis and suggestions pursuant to the practice.
