Özet

Vasiyetname tek taraflı ölüme bağlı bir tasarruf olup, mirasbırakanın son arzularını içerir. Vasiyetçinin ölümüne kadar geçecek sürede bu konudaki arzuları her zaman değişebilir. Bu kapsamda vasiyetname, vasiyetçi tarafından onun ölümüne kadar her zaman geri alınabilir. Türk Medeni Kanunu m. 542 vd. hükümlerinde düzenlenen "Vasiyetnameden Dönme" çalışmamızın konusunu oluşturmaktadır. Vasiyetnameden dönme, vasiyetçinin yeni ölüme bağlı tasarruf yapmasıyla veya vasiyetnemeyi yok etmesiyle ya da vasiyet konusu şeyde sağlararası tasarrufta bulunmasıyla mümkün olabilir. Türk Medeni Kanunu m. 542 kapsamında vasiyetçi yeni bir ölüme bağlı tasarruf ile önceki vasiyetnamesinden dönebilir. Bu ölüme bağlı tasarrufun mutlaka dönülen (geri alınan) vasiyetname ile aynı şekilde yapılmış olmasına gerek bulunmamaktadır. Dönme, Türk Medeni Kanunu m. 542/2'de ifade edildiği üzere tamamen veya kısmen olabilir. Yine vasiyetname açık şekilde geri alınabileceği gibi örtülü olarak da geri alınmış olabilir. Türk Medeni Kanunu m. 544/1'de mirasbırakanın önceki vasiyetnamesini ortadan kaldırmaksızın yeni bir vasiyetname yapması durumunda, kuşkuya yer bırakmayacak şekilde önceki vasiyetnameyi tamamlamadığı anlaşılmadıkça, sonraki vasiyetnamenin onun yerini alacağı hükme bağlanmıştır. Türk Medeni Kanunu m.543/1'e göre vasiyetnamenin yok edilerek geri alınması mümkündür. Bunun için vasiyetçinin kastının bu yönde olması gerekir. Son olarak Türk Medeni Kanunu m. 544/2 kapsamında, vasiyetçi, vasiyet konusunda, sağlararası tasarrufta bulunmak suretiyle de vasiyetten dönebilir. Bu bakımdan sağlararası tasarrufun ivazlı ya da ivazsız olmasının bir önemi bulunmamaktadır.

Abstract

The testament is a kind of testamentary disposition that contains the last desires of the testator. The desires of the testator may show changes at any time on the subject matter pertaining thereto within the period of time that may elapse until the death of the testator. Within this scope, the testament may always be revoked by a testator until his/her death. "Revocation of the Testament" that is regulated in the provisions of Article 542 and subsequent articles of the Turkish Civil Code constitutes the subject matter of our study. The revocation of the testament may be possible by the disposition of subject to a new death of the testator or destruction of the testament or making a disposition between the alive ones on the matter forming the subject matter of the testament. The testator may always revoke his/her former testament by a new disposition subject to a new death within the scope of Article 542 of the Turkish Civil Code. There is not any requirement to make such disposition depending on death to be made in the same way with the revoked testament. The revocation may either be partially or totally as is indicated in Article 542/2 of the Turkish Civil Code. Likewise, it is possible for the testament to be revoked clearly. It is adjudged in Article 544/1 of the Turkish Civil Code that in case the testator issues or makes a new testament without revocation of his/her previous testament, the subsequent testament shall replace it unless she/he does not complete his/her previous testament. It is also possible to revoke a testament by the destruction of it according to the provision of Article 543/1 of the Turkish Civil Code. For this, the intention of the testator has to be in this direction. Finally, the testator may revoke the testament by making disposition between the alive parties on the testament within the scope of Article 544/2 of the Turkish Civil Code. In this respect, there is not any importance whether the disposition between the alive parties is onerous or gratuitous
