Özet

Anayasa Mahkemesi'ne bireysel başvuru yapılabilmesi için gerekli olan koşullardan biri, başvuru yapmadan önce, ileri sürülen ihlali gidermek için mevzuatta öngörülmüş idari ve yargısal başvuru yollarının tüketilmesidir. Mahkeme'nin yaklaşımına göre tüketilmesi gereken bu yollar, ihlalin giderilmesi için etkili ve erişilebilir olan yollardır. 3 yıllık bireysel başvuru uygulamasında Anayasa Mahkemesi, başta bu "etkili ve erişilebilir yolların tüketilmesi'' olmak üzere tüketme kuralına ilişkin çeşitli yaklaşımlar geliştirmiştir. Bunların büyük bir kısmı, insan haklarının etkili bir şekilde korunması adına olumlu ve geliştirici olmakla birlikte; bu süreçte insan haklarının korunması adına olumsuz ve sorunlu sayılabilecek örnekler de bulunmaktadır. İnsan haklarının korunması için önemli anayasal mekanizmalardan biri olan bireysel başvuru (anayasa şikayeti) uygulamasında, temel hak ve özgürlüklerin esası (konusu, kapsamı, öznesi, sınırları vs.) kadar, kabul edilebilirlik kriterleri ve bu bağlamda da bilhassa tüketme koşuluna ilişkin benimsenebilecek bir yaklaım da, insan haklarının korumasında olumlu veya olumsuz rol oynayabilmektedir. Bu makalede de, 3 yıllık bireysel başvuru uygulamasında, Mahkeme'nin tüketme koşuluna ilişkin olumlu ve olumsuz uygulamaları ele alınacaktır.

Abstract

One of the conditions of lodging an individual application/ constitutional complaint to the Constitutional Court is exhausting administrative and judicial remedies laid down in the legislation to remedy the alleged breach. The Constitutional Court opines that the remedies that must be exhausted are those that are accessible and effective to repair the breach. The Court has developed some approaches towards the exhaustion rule, including the above-mentioned one ("exhaustion of only the accessible and effective ones''). Most of them are useful and constructive in terms of effective protection of human rights whereas there have been some deteriorative and problematic examples in this 3 years' period. Regarding the individual application (constitutional complaint) mechanism which is a very significant tool for the protection of human rights, an approach towards the admissibility criteria and especially the rule of exhaustion has the potential to play a deteriorative or otherwise constructive role as much as an approach towards the substance (the scope, subjects and limits etc.) of the fundamental rights and freedoms might do. In this article we will deal with the good and bad approaches, exercises and arguments that the Constitutional Court have developed and put forward through application of individual application mechanism through the last three years.
