Özet

Gemiler hem insan hatalarından hem de deniz tehlikelerinden do-layı sürekli risk altındadırlar. Deniz kazaları alınan tüm önlemlere rağ-men bu sektörün ayrılmaz bir parçası olmaya devam etmektedir. Kaza-lar, kurtarma sektörünün doğmasına neden olmuş ve kurtarılan değerler nedeniyle, kurtarma faaliyetleri denizcilik için önemli bir alan haline gelmiştir. Gelişen küresel ticaret, gemi teknolojisi ve yaşanan kazalar kurtarmanın hukuki rejiminde de değişikliklere yol açmıştır. Günümüzde kurtarma rejimi 1989 Londra Konvansiyonu ile düzenlenmiştir. Türkiye Cumhuriyeti, ilgili konvansiyonu 2013 tarihinde kabul etmiş ve Türk Ticaret Kanunu’nda düzenlenen kurtarma hükümleri de konvansiyona uygun olarak değiştirilmiştir. 1989 Londra Konvansiyonu ve Türk Tica-ret Kanunu’ndaki değişikliklerin yanında limanlar mevzuatı geçtiğimiz yıllarda değişikliğe uğramış ve kurtarma faaliyetlerini etkileyen önemli bir düzenleme yürürlüğe sokulmuştur. Bu çalışmada; değişikliğe uğra-yan limanlar mevzuatı kurtarmanın tanımı ve unsurları çerçevesinde incelenecek ve değişikliğin bir Kamu İktisadi Teşebbüsü olan Kıyı Em-niyeti Genel Müdürlüğü’ne ait tekel kurtarma hakkına etkisi üzerinde durulmaktadır.

Abstract

Risk is an integral element of maritime transport. Vessels, its car-go and other properties could be exposed to not only human errors but also other dangers. However, despite all measures, sea accidents remain as inseparable part of this sector. On the other hand, accidents caused the creation of “salvage sector”, and due to salvaged values, it has be-come a significant area in the maritime sector. The developing global trade, ship technology and accidents have also caused the changes in legal regime of salvage. Today, the salvage regime has been regulated by the 1989 London Convention. The Republic of Turkey adopted the relevant Convention in 2013 and salvage provisions in the Turkish Commercial Code have also been established based on the convention. Besides changes in the London Convention and Turkish Commercial Code the port regulation of Turkey has been modified in recent years and most important rules effecting salvage services have come into ef-fects. In this study, port regulation alterations are studied in the fra-mework of definition and elements of salvage and the effects of alterati-ons on Directorate General of Coastal Safetys’ salvage monopoly right are considered.
