Özet
Anayasa’da bir hak olarak güvence altına alınan çevrenin korun-ması, hem idareye hem de bireylere bu konuda sorumluluklar yüklemek-tedir. Ancak, Çevre Kanunu’nda da belirtildiği üzere çevrenin korunması başta idarenin görevidir. Deniz kirliliğinin önlenmesi de idarenin çevreyi koruma görevinin bir parçasını teşkil etmektedir. Genel olarak çevre kirliliğinde olduğu gibi deniz kirliliğinde de, kirliliğin tespit edilmesi ya da tanımlanmasındaki zorluk yargı organlarının karşılaştığı önemli so-runlardan biridir. Danıştay kararlarına yansıyan bu çeşitlilik, deniz kirli-liğinin çok farklı şekillerde ortaya çıkabileceğini göstermektedir. İdare, çeşitli şekillerde oluşan söz konusu kirliliğinin önlenmesinden sorumludur. Bu sorumluluk, Çevre Kanunu’nda genel olarak belirtilmişse de bu kanun dışında çeşitli kanun ve düzenlemelerde idarenin deniz kirliliğini önleme yükümlülüğüne ilişkin ayrıntılı hükümler yer almaktadır. Bu hükümlerin genel çerçevesinin belirlenmesi kirliliğin önlenmesi nokta-sında idare içindeki görev paylaşımının anlaşılmasını sağlayacaktır. Çev-renin korunmasına yönelik düzenlemelerin yapılmasının yanı sıra idare-nin gerekli denetimlerin yapılması yoluyla kirliliğe engel olmak ve kirli-lik sonrası yaptırımlar uygulamak şeklinde iki farklı görevinin olduğu söylenebilir.
Abstract
The protection of the environment, which is guaranteed as a right in the Constitution, imposes responsibilities on both the administration and the individuals. However, as stated in the Environmental Law, envi-ronmental protection is primarily the duty of the administration. Preven-tion of marine pollution is also part of the administration's duty to pro-tect the environment. As in environmental pollution in general, in marine pollution, the difficulty in detecting or defining pollution is one of the major problems faced by judicial bodies. This diversity, which is reflect-ed in the decisions of the Council of State, shows that marine pollution can occur in many different ways. The administration is responsible for the prevention of such pollution that occurs in various ways. Although this responsibility is generally stated in the Environmental Law, the rare detailed provisions regarding the obligation of the administration to prevent marine pollution in various laws and regulations apart from this law. The determination of the general framework of these provisions will provide an understanding of the task sharing within the administration at the point of preventing pollution. In addition to making regulations for the protection of the environment, it can be said that the admin-istration has two different duties: preventing pollution through the nec-essary inspections and imposing post-pollution sanctions.
