Özet

Cinsiyet değişikliği, 2002 yılında yürürlüğe giren 4721 sayılı TürkMedeni Kanunu’nun 40. maddesinde yeniden düzenlenerek birtakımkoşullara bağlı tutulmuştur. Bu düzenlemeye göre mahkemeye izin başvurusunda bulunan istem sahibinin on sekiz yaşını doldurmuş olması veevli olmaması; ayrıca transseksüel yapıda olup, cinsiyet değişikliğininruh sağlığı açısından zorunluluğunu bir eğitim ve araştırma hastanesinden alınacak resmî sağlık kurulu raporuyla belgelemesi şarttır. Bu düzenlemede ilk göze çarpan husus kişinin transseksüel yapıda olması gereğidir. Transseksüel, içerisine doğduğu biyolojik cinsiyetten farklı bircinsel kimlik taşıyan bireylere verilen addır.Mahkemeden alınan izne dayanılarak, amaç ve tıbbî yöntemlereuygun bir cinsiyet değiştirme ameliyatının gerçekleştirildiğinin, resmisağlık kurulu raporu ile ispat edilmesi halinde mahkeme nüfus sicilindegerekli düzeltmenin yapılmasına hükmeder.

Abstract

The sex change has been rearranged in Article 40 of Turkish Civil Code No. 4721 which entered into force in 2002, and has been adhered to certain conditions. According to this arrangement, it is stipulated for the person applying to the court for request of permission to be over the age of eighteen and not to be married; furthermore to be certificated of being in transsexual nature; must be documented that the sex change is imperative for mental health through an official medical board report taken from a training and research hospital. The first factor in this regulation is the necessity for the applicant to be in a transsexual nature. Transsexual is the name given to individuals who have a different sexual identity than the biological sex they are born into. The court decides to make necessary amendment in civil status registry in the case realization of the gender reassignment surgery in compliance with the aim and medical methods based on the permission taken from the court is verified through an official medical board report.
