YENİ NESİL İKİLİ YATIRIM ANLAŞMALARINDA GÜNCEL EĞİLİMLER

Özet

Uluslararası yatırım hukukunun en önemli vasıtalarından Yatırım-ların Karşılıklı Teşviki ve Korunması Anlaşmaları (YKTK), ev sahibi devlete sunduğu katkı ile taşıdığı risk dengesi açısından tartışılmaktadır. YKTK anlaşmalarında yer alan yatırım ve yatırımcı kavramları, en çok gözetilen ulus kaydı, kamulaştırma, şemsiye hükümler ve uyuşmazlık çözüm mekanizması gibi en temel hükümler, akdedilen yeni nesil ikili yatırım anlaşmalarında gözden geçirilmekte ve güncel reform çalışmala-rının konusunu teşkil etmektedir. Bu çalışmanın amacı, yeni nesil YKTK anlaşmalarındaki güncel gelişmeler ve eğilimleri analiz etmektir.

Abstract

Bilateral Investment Treaties (BIT’s), one of the major instruments of the international investment law, have been critically argued in terms of the balance of risks and benefits provided to the host states. The scope of investment and investor, most favoured nation (MFN), expropriation, dispute resolution clauses and other critical provisions are subject to review in the new generation of BIT’s and discussed in recent investment law reforms. The aim of this study is to analyze the changes and current developments in the new generation of BIT’s.
