Özet

5711 sayılı Kanun ile 'toplu yapı' kavramı ilk kez Kat Mülkiyeti Kanunu'na (KMK) girmiştir. Bununla birlikte KMK'nın dokuzuncu bölümünde toplu yapılarda yönetime ilişkin düzenlemeler de getirilmiş bulunmaktadır. Bu makalede, 'toplu yapılarda yönetici veya yönetim kurulu' bahsi tüm yönleriyle ele alınmıştır. İlk olarak 'yönetim' ve 'yönetici' kavramları açıklanmış ve 5711 sayılı Kanun yürürlüğe girmeden önce toplu yapılarda yönetim düzeninin nasıl olduğu ortaya konulmuştur. Ardından KMK m. 71'e göre yönetici veya yönetim kurulu seçimi detaylarıyla incelenmiştir. KMK m. 74'ün atfı gereği, klasik kat mülkiyetinde yöneticinin görevlerini, sorumluluklarını ve haklarını düzenleyen KMK'nın ilgili maddeleri de bu çalışma kapsamındadır.

Abstract

The concept of 'condominium complexes' has first been integrated into the Turkish Condominium Code (TCC) by virtue of the 5711 numbered Act. The regulations regarding the management of condominium complexes have also been brought under Section 9 of the TCC. In this article, the subject of 'manager or board of management at condominium complexes', has been dealt with, in all its aspects. Firstly, the concepts of 'management' and 'manager' have been explained, and the regime prior to the entry into force of the Act No. 5711 has been set forth. Then, the election of a manager or a board of management under Article 71 of the TCC is examined in detail. The relevant articles of the TCC concerning the duties, liabilities and rights of a manager in a basic condominium are also within the scope of this paper, due to the reference in Article 74 of the TCC.
