Özet

Koronavirüs hayatımızı etkiledi. Bu etki sadece sağlık alanıyla ilgili değil. Sosyal hayatımız, yeme alışkanlıklarımız, toplanma biçimlerimiz, eğitim hayatımız, çalışma türlerimiz başta olmak üzere eski alışkanlıklarımız yerini yeni şeylere bıraktı. Birlikte yaşamanın temel kurallarını düzenleyen hukuk da bundan nasibini aldı. Dünya yeni bir dönüm noktasında. Hukuk da bu değişimin bir parçası olacak. Devletlerin yasaları “pandemi” gündemiyle yeniden düzenlenecek. Toplumu tehdit eden unsurlar arasında “biyoloijk saldırı” meselesi belirsiz olmaktan çıkıp, toplumum başından geçmiş bir olay olarak belirecek. Bu değişim döngüsünün uluslararası ilişkileri etkilemesi de olasıdır. Uluslararası hukukta bu konu sebebiyle gündeme gelecek davalar olacaktır. Yine devletlerin bu konuda yapacakları başvurular uluslararası mahkemeler ve kurumların gündemini işgal edeceğe benziyor. Bu makalede, olası durumları mevcut uluslararası hukuk düzeni üzerinden değerlendirmeye çalışacağız.

Abstract

The coronavirus affected our lives. This effect is not only related to the field of health. Our old habits, especially our social life, eating habits, ways of gathering, our education life, our types of work, have been replaced by new things. The law that regulates the basic rules of living together also got its share. The world is at a new turning point. Law will be a part of this change. The laws of the states will be reorganized with the “pandemic” agenda. The issue of “biological attack” among the elements that threaten the society will not be uncertain, and my society will appear as an incident. This cycle of change is also likely to affect international relations. In international law, there will be cases that will come to the agenda due to this issue. Again, the applications to be made by the states on this issue seem to occupy the agenda of international courts and institutions. In this article, we will try to evaluate possible situations through the current international legal order.
