Özet
Sosyal güvenliğin denetimi çalışanların sosyal güvenliğini sağlamak, haksız rekabeti önlemek, SGK'nın prim kaybını en aza indirmek, sosyal tarafları bilinçlendirmek gibi amaçlarla yapılan kamusal dış denetim yöntemidir. Bu bağlamda, asgari işçilik incelemesi ise kendine özgü kıstasları, yöntemleri olan detaylı bir denetim türüdür. Sosyal güvenlik sistemi içinde asgari işçilik özellikle kayıt dışı istihdam ile mücadelede etkili araçlardan birisidir. Asgari işçilik uygulaması özel bina inşaatları, ihale konusu işler ve devamlı işyerleri kapsamında uygulanır. Bu kapsamda SGK tarafından belirlenen hesaplama yöntemleri ile işin yürütümü için gereken en az işçilik (eksik işçilik) tutarı hesaplanmakta ve bu tutar için gerekli prim miktarı işverenlerden tahsil edilmektedir. Bu makalede asgari işçilik tespit yöntemleri incelenmiş ayrıca özel bina inşaatları, ihale konusu işler ve devamlı işyerleri açısından asgari işçiliğin uygulama esasları üzerinde durulmuştur.
Abstract
The inspection of social security is an external public audition method which is made with the deeds such as, to ensure the employees' social security rights, to prevent unfair competition, to minimize the loss of premium earning of the SSI, to raise awareness at the social partners. In this regard, the minimum labour inspection is a specific method of inspection with its particular specialities and detailed inspection methods. The minimum labour inspection in the social security system is an effective audition tool specifically to combat unregistered employment. The minimum labour practice is being implemented for the private constitution businesses, the tender jobs and at the permanent workplaces. In this context, the minimum labour, which is needed for the execution of the work (the required missing workmanship) is being calculated by the SSI with specified calculation methods and the premiums for these amount is being collected from the employers. In this article, the minimum labour inspection methods are being examined and the application principles of the minimum labour inspection at the tender jobs and permanent workplaces are being investigated.
