Özet

Türk rekabet hukuku, Pişmanlık Yönetmeliği'nin kabulüyle birlikte kartellerle mücadelede sağladığı faydalar konusunda üzerinde oydaşma olan bir araç kazanmıştır. ABD ve AB gibi hukuk düzenlerinde pişmanlık programları sayesinde elde edilen başarıların etkisiyle oluşan bu oydaşma, benzer bir sonucun Türkiye'de de sağlanabileceğinin güçlü bir işareti olsa da, teminatı değildir. Çünkü Türkiye'de aynı sonucun elde edilebilmesi, diğer hukuk düzenlerinde olduğu üzere, bazı ön koşulları gerektirmektedir. Kaldı ki bu ön koşullar sağlansa bile, Pişmanlık Yönetmeliği, kapsam, esas, koşullar, usul gibi konularda belli hususları içermelidir. Bu çerçevede makalenin amacı, Pişmanlık Yönetmeliği'nin kapsam, esas, koşullar, usul gibi konularda olması gerekenleri içerip içermediğini incelemektir. Bu amaç doğrultusunda, gelişmiş rekabet hukuku sistemlerindeki pişmanlık programlarıyla karşılaştırma yapılarak, daha sağlıklı sonuçlara ulaşılmaya çalışılacaktır. Bu karşılaştırma, Pişmanlık Yönetmeliği'nin, yukarıda zikredilen ön koşulların mevcudiyeti varsayımı altında, kartellerle mücadelede başarının elde edileceği yeni bir dönemin başlangıcını sağlayıp sağlayamayacağını ortaya koyacaktır.

Abstract

A new tool for the fight against cartels has been introduced to the Turkish competition law with the adoption of the leniency program. While the consensus on the success of leniency programs, which has been established due to the success in jurisdictions such as the US and the EU, is a strong indicator of the similar result to be achieved in Turkey, this is not a guarantee itself because this result can only be achieved if some universal prerequisites are provided. In addition to these prerequisites, leniency program should satisfy specific qualifications on the areas such as the scope, substance, conditions, and procedure. Therefore, the purpose of this article is to analyze whether the leniency program has these necessary qualifications. In order to end up with more accurate conclusions, Turkish leniency program will be compared with the leniency programs of developed competition law systems. Under the assumption of the presence of the aforementioned prerequisites, this comparison will also answer the question whether the leniency program starts a new era in which the success will be achieved in the fight against cartels.
