İSLÂM HUKUKUNDA KARANTİNA AHKÂMI

Özet

Dünyanın yaratılışından itibaren ilâhî nizam gereği birtakım hastalıkların canlıların peşini bırakmadığı herkesin mâlumudur. Geçmiş yüzyıllarda insanın aciz kaldığı endemik, epidemik ve pandemik salgın hastalıkların ve deprem, sel, kasırga, heyelan vb. olağanüstü afetler sebebiyle kısmî helaklerin yaşanması bu yargının en somut delilidir. COVİD-19 Yeni Koronavirüs salgın hastalığı ise çağımızda yaşanan canlı şahit mesabesindedir. Böylesine ciddi ve herkesi tehdit eden ölümcül salgın hastalıklara karşı Hz. Peygamber ve İslam ümmeti sessiz kalmamış, her alanda olduğu gibi bu alanda da asırlar öncesinden aldığı tedbirler ve uyguladığı korunma yöntemleriyle insanlığa örnek olmuştur. Bu tedbirlerden birisi de hiç şüphesiz karantina uygulaması ve esnasında başvurulan birtakım koruyucu metotlardır. Hz. Peygamber dönemi ve sonraki dönemlerde salgın hastalıklara karşı takınılması gereken ilk tavrın koruyucu hekimlik, sonraki tavrın ise karantina uygulamak olduğu müşahede edildiğine göre İslâm'da karantina ahkâmının mevcut olduğu açıkça söylenebilir. Binaenaleyh bu araştırma İslâm’da karantinanın hukukî boyutunu ve bu uygulama esnasında başvurulan bazı metotları ele almayı amaçlamaktadır.

Abstract

As of the divine order, since the world was created, it is the followers of everyone that certain diseases do not chase living things. Endemic, epidemic, and pandemic diseases in which human beings have been incapable in the past centuries and earthquake, flood, hurricane, landslide etc. partial destruction due to extraordinary disasters are the most concrete evidence of this judgment. COVID-19 New Coronavirus epidemic is live witness in our age. The Prophet and the Islamic Ummah did not remain silent against such serious and threatening deadly epidemic diseases and has set an example to humanity in this field, as in every field, with the measures it has taken before centuries and the methods of protection it has implemented. One of these measures is undoubtedly the quarantine application and some protective methods applied during. According to the Prophet period and subsequent periods, the first attitude to be taken against epidemics is preventive medicine and the next attitude is to apply quarantine, it can be said clearly that there is a quarantine in Islam. Therefore, this research aims to discuss the legal dimension of the quarantine in Islam and some methods used during this practice.
