The Role of the Turkish Ombudsman in the Legal Based Administrative Audit in the Framework of Ronald Dworkın’s Legal Theory

Özet

Ronald Dworkin’in hukuk kuramı temel olarak bir yorum kuramıdır. Dworkin, hukuku normlar ve il-kelerin bütün olarak yorumlandığı bir sistem olarak kabul eder. Bir bütün olarak hukuk, özünde hakları koruyan ve ortak yaşamın devamlılığını sağlayan bir yapıdır. Kamu Denetçiliği Kurumu (Ombudsman) idarenin her türlü eylem, işlem, tutum ve davra-nışını insan haklarına dayalı adalet anlayışı içinde hukuka ve hakkaniyete uygunluk yönünden incele-mekle görevlendirilmiştir. Bu anlamda idarenin ey-lem ve işlemlerini mevzu hukuk dışında hakkaniyet bakımından incelemesinde kullandığı ilkeler temel insan hakları ilkeleri olarak karşımıza çıkmaktadır. O halde, Dworkin’in hukuk anlayışı içerisinde yo-rumcunun aldığı rolle ombudsmanın hakkaniyet denetimi görevi arasında bir bağ kurulabilecektir. Ombudsmanın hakkaniyet denetimi görevini ifa ederken normlarla temel insan hakları ilkelerini birlikte yorumlaması ile Dworkin’in yorum teorisi arasındaki benzerlik makalenin temel konusudur.

Abstract

Ronald Dworkin’s theory of law is basically a theory of interpretation. Dworkin considers law as a system in which norms and principles are interpreted as a whole. Law as a whole is essentially a structure that protects rights and ensures the continuity of common life. The Ombudsman is tasked with examining all actions, procedures, attitudes and behaviors of the administration in terms of compliance with law and equity within the understanding of justice based on human rights. In this sense, the principles used by the administration in the investigation of the actions and operations of the administration in terms of equity outside the law appear as basic human rights principles. Thus, a link can be established between the role of the interpreter in Dworkin’s understanding of law and the role of the ombudsman’s equity control. The similarity between Dworkin’s theory of interpretation and the Ombudsman’s interpretation of norms and fundamental human rights principles in the exercise of the task of fairness control is the main subject of the article.
