Özet

Türk fikri mülkiyet sistemi 1995 yılında modernize edilmiştir. Bu sistemin bir parçası olarak patent, faydalı model ve tasarım gibi fikri ürünlere özgü hukuki düzenlemeler yapılmıştır. Yasa koyucular buluş ve tasarım sahibine münhasır yetkiler vererek bir süre fikri ürününü rekabete karşı korur. Fikri ürünü korumakla yasa koyucular, ilgili ürün grubunda pazardaki rekabetin süreli olarak sınırlandığının, hatta somut olaya bağlı olarak yok edilebileceğinin farkındadır. Yasa koyucular, buluşların ve özgün tasarımların promosyonu ile serbest rekabet arasında denge kurarlar. Bu dengenin sağlanabilmesi bakımından fikri mülkiyet korumasının süreli olması işin doğası gereğidir. İşte tam burada tescilsiz fikri ürünlerin hangi şartlarda korunacağı sorusu akla gelmektedir. Bu konu Türk hukukunda özel olarak düzenlenmemiş olup, sorunun çözümü doktrin ve içtihat hukukuna kalmıştır. Sorun, başka hukuklarda da önemli tartışmalara yol açmıştır. Elinizdeki çalışmada karşılaştırmalı hukuk ışığında bir inceleme yapılmıştır. Bu yapılırken özellikle Türk içtihat hukukunda benimsenen yaklaşımın kritiği yapılarak öneriler getirilmiştir.

Abstract

Turkish intellectual p roperty system was modernised in 1995. As a part of this system, legal regulations specif ic to intellectual p roducts such as patents, utility models and designs have been made. Legislators p rotect the intellectual p roduct f or a while by granting exclusive rights to the owner of the invention and design. By p rotecting the intellectual p roduct legislators are aware that the competition in the related p roduct market is restricted f or a certain period even eliminated depending on the concrete case. Legislators try to establish a balance between the p romotion of inventions and original designs and f ree competition. In order to establish this balance the f act that the intellectual p roperty p rotection is p rovided f or a limited time period is a matter of course. At this point the question of under which conditions the unregistered intellectual p roducts will be p rotected comes to mind. This issue has not been specif ically regulated in Turkish legislation; the p roblem is solved by doctrine or case law. The p roblem has also raised many discussions in other law systems. In this work a study within a perspective of comparative law has been made. And in order to achieve this, especially the app roach adopted by Turkish case law has been criticized and suggestions have been made.
