Özet

Laiklik kavramı, din ve devlet ilişkisinin barışçı bir şekilde çözümü konusunda akıl yürütmenin bir sonucu olarak ortaya çıkmıştır. Geçmişte laisizmi çağrıştıran uygulamalar, toplumda laiklik konusunda farklı düşüncelere sebep olmuştur. Evrensel anlamı içinde laiklik, bireyleri ve düşüncelerini eşit kabul eden, iyi düşüncesi dayatmayan, ötekileştirmeyen, ayrımcılığı ortadan kaldıran, taraf tutmayan bir devlet mekanizması ile insanların barış ve huzur içinde yaşamalarını garanti altına almanın yoludur. Devletin belli bir din ya da mezhep referanslı kurumsallaşması diğer din ya da mezheplerin yasaklanmasına kadar giden bir sürece neden olabilmektedir. Bu gerçek ve tecrübe göstermiştir ki dini özgürlükler içinde evrensel anlamıyla kabul gören bir laiklik toplumsal barış için geliştirilen en önemli çözüm yollarından biridir. Laiklik toplumların kültürel kodlarını inkar etmeden, toplumu oluşturan tüm bireyleri kendi iyi ve doğruları ile birlikte yaşatabilen uzlaşmacı bir hukuk kavramıdır.

Abstract

The concept of laicite1 has emerged as a result of debutes about a peaceful solution of the relationship between state and religion. In the past, policies that resemble laicisme resulted in different thougts about laicite. Laicite, within its universial meaning, is a way to make sure that people live in peace and harmony with a government mechanism which considers individuals and ideologies equal, abolishes, discrimination, does not insist on the good and does not externalize. An establishment of a state in the frame of a religion or sect can cause a process where other religions or sects to be prohibited. This fact and experience have shown us that a laicite that is acceppted in its universial meaning even for religious freedoms is one of the most important solutions for social peace. Laicite, is a comprimising legal concept which enables all members of the societies to live with their own good and right without denying the cultural codes of the societies.
