Özet

6100 sayılı HMK‟da yetki sözleşmeleriyle ilgili getirilen yeni düzenleme, MÖHUK uygulaması ile benzer ve farklı yönler taşımaktadır. Bu çalışmada, MÖHUK ve HMK düzenlemeleri ele alınarak, iki kanunun yetki sözleşmeleri konusundaki benzerlik ve farklılıklarına işaret edilmeye çalışılmıştır.

Abstract

Turkish Code of Civil Procedure (numbered 6110)‟s (HMK) regulation on jurisdiction agreements has common and different aspects with the Turkish Code Concerning Private International Law and Civil Procedure (MÖHUK). This article aims to identify these similarities and differences between these two codes by analyzing the jurisdiction agreements in HMK and MÖHUK.
