Özet
Türk hukuku bakımından belirsizliğini koruyan “sıfat” kavramının, her tür hukuk davası bakımından işlerlik kazanacak şekilde yeniden ta- nımlanması ve kavrama bütünüyle usulî bir anlam kazandırılması müm- kün görünmektedir. Bu yeni bakış açısında, kullanılacak araç ise “da- vada menfaat” kavramıdır. Buna göre, davacı sıfatı, kural olarak dava açıp esasa ilişkin lehine bir hüküm elde etmekte doğrudan ve kişisel bir menfaati bulunan kişiye; davalı sıfatı ise, aleyhine açılan davanın reddini sağlamakta doğrudan ve kişisel bir menfaati olan kişiye aittir. Bu kuralın istisnası ise, davacı ve davalı sıfatının kime ait olduğunun açıkça kanun tarafından belirlendiği durumlardır. Bu durumlarda, davacı veya davalı- nın kim olduğunun belirlenmesi için menfaat kavramının kullanılmasına ihtiyaç yoktur. Kanunun işaret ettiği kişi olunduğunun kanıtlanması ye- terlidir. Ancak, kanun bir davada davacı veya davalı olabilecekleri “il- gili” olarak nitelemişse, durum genel kuralın tekrarından ibarettir.
Abstract
It is possible to redefine and give an entirely processual meaning to the concept of “capacity to sue or to be sued”, which is still a blurry concept in Turkish law, for every type of civil suit. In this new point of view, the tool that will be used is the concept of “interest”. According to this, “capacity to sue” belongs to the party that has the direct and personal interest to file a civil suit in order to gain a meritorious decision on his or her behalf and “capacity to be sued” belongs to the party that has the direct and personal interest to ensure the rejection of the claim that is brought before the court against him or her, in principle. Exceptions of this principle are the cases, in which, both capacity to sue and to be sued is determined explicitly by the law. In these exceptions, there is no need to use the concept of “interest” in order to determine the plaintiff and defendant and proving being the party that is determined by the law would be sufficient. However, if the law characterized the plaintiff and the defendant as the “concerned parties” in a certain case, than the main principle that is explained above will become effective again.
