Özet

İcra ve İflas Kanunu çeşitli sebeplerle, borçlunun bazı mallarının haczedifemeyeceğine dair hükümler getirmiştir. Bunlardan biri de devlet mallarının haczedilememesidir. Kanun devlet mallarında bir ayrım yapmamıştır. Bu nedenle devletin hem kamusal malları hem de özel malları haczedilememektedir. Devlet mallarının haczedilmemesinde en temel gerekçe, kamu hizmetlerinin devamlılığı ve aksatılmamasıdır. Ancak devlet mallarının haczedilmezliği kuralı çok geneldir. Bu nedenle devletin kamu hizmeti görmeyen malları da haczedilememektedir. Bu ise, devletten alacaklı olan kişiler açısından ciddi sorunlar ortaya çıkarmaktadır. Konu Anayasa Mahkemesi'nin önüne gelmiş, ancak Anayasa Mahkemesi bu hükmü Anayasa'ya aykırı bulmamıştır. Ancak bu hüküm temel insan hakları bakımından sorunludur. Özellikle hukuk devleti, mülkiyet hakkı, eşitlik ilkesi, hak arama özgürlüğü yönlerinden sorunlu bir düzenlemedir. Devlet mallarının haczedilmezliği ve alacağın tahsil edilememesi sebebiyle Avrupa İnsan Hakları Mahkemesi'ne başvuru yapılmış, mahkeme başvuranın lehine karar vermiştir. Dolayısıyla artık bu hükmün sözleşme hükümlerine uygun hale getirilmesi veya tamamen kaldırılması gerekmektedir. Bu hüküm kaldırılmasa bile Anayasa'nın 90.maddesi gereği artık gerek icra daireleri gerekse icra mahkemeleri haczedilmezlik kuralını dikkate almamalıdırlar.

Abstract

The Execution and Bankruptcy Code have some provisions that some properties cannot he seized. One of these provisions stipulates that state's properties cannot be seized. Law did not differentiate state's properties. Therefore, both public and private properties of state are not attachable. The aim of this rule is to „provide continuity of public services. However, this rule is so general. Thus, the property that is not assigned to a public service also cannot be seized. Then, this situation creates some problems for creditors from state. This issue was examined by Turkish Constitutional Court. However, it did not find that this provision is contrary to Turkish Constitution. Nevertheless, this provision is problematic in terms of fundamental human rights. In particular, it is problematic in terms of the rule of law, the right of property, principle of equality, right to legal remedy. In this respect, the application was lodged with the European Court of Human Rights and it decided in favor of the applicant. Thus, this provision should be consistent with the Convention or it should be annulled. Even it is not been annulled, execution office and court of execution should not take into account the rule of non-seizable of states properties in accordance with the Article 90 of Turkish Constitution.
