Özet
Federal Adalet Mahkemesi, Almanyanın en yüksek dereceli ceza ve hukuk mahkemesidir. Federal Adalet Mahkemesinin hakimleri bu alanda çalışarak ve ilerleyerek kariyer sağlamaktadır. Federal hakim ofisi de, genel anlamda bu kariyerin zirvesidir. Hakimler özel bir seçim kurulu tarafından seçilir ve Federal başkan tarafından tayin edilirler. Davaların yürütülmesinde yüksek mesleki standartların korunması amacıyla Federal Adalet Mahkemesinin kendine özgü bir barosu vardır. Şu an, Barolar Birliği yalnızca Federal Mahkemeye kabul edilmiş 41 avukata sahiptir. Federal Adalet Mahkemesi şu alanlarda yargılama yetkisini haizdir: Temyiz kanun yolu, kanun yoluna başvurunun reddedilmesine karşı şikâyetler, hukuki konularda şikâyetler, patentin iptali yargılamaları, Federal Patent Mahkemesi kararlarına karşı istinaf kanun yoluna başvuru ve adli yardıma başvurulması gibi tali yargılamalar, yargı yerinin belirlenmesi, görev uyuşmazlığı, hukuki dinlenilme hakkının ihlaline karşı şikâyetler vb.
Abstract
The Federal Court of Justice (Federal Court) is the supreme civil and criminal court of Germany. The judges of the Federal Court of Justice are career judges. The Federal Court is typically the peak of the career for a judge. Judges are chosen by a special election committee and appointed by the President of the Federal Court. To secure a high professional standard in the handling of cases, the Federal Court has a special bar. At present, there are 41 lawyers who are members of the German Bar Association and who are admitted to the Federal Court only. The Federal Court has jurisdiction over final appeals, complaints against denial of appeal, complaints on points of law, first appeals in patent revocation proceedings against decisions of the Federal Patent Court, and collateral proceedings, such as applications for legal aid conflicting decisions on jurisdiction, restoration of position complaints against a violation of the right to be heard and similar matters.
