Özet
Tahkim itirazı, Hukuk Muhakemeleri Kanununda da Milletlerarası Tahkim Kanunundaki gibi ilk itiraz olarak düzenlenmiştir. Tahkim ilk itirazı davanın başında ileri sürülecek ve incelenecektir. Tahkim ilk iti- razı incelenmeden tahkikat aşamasına geçilmeyecektir. Böylelikle yar- gılamanın daha sonraki aşamalarında tahkim itirazının ileri sürülerek yargılamanın gecikmesi, zaman ve masraf kaybı önlenmek istenmiştir. Tahkim itirazı kabul edilirse, davanın “usulden reddine” karar ve- rilecektir. Usulden red kararı yerine “görevsizlik” veya “dava dilekçesi- nin reddine” karar denilmesi doğru değildir. Tahkim itirazının kabulü üzerine mahkemenin gönderme kararı ve- receği söylenmiş ise de, bu teknik anlamda görevsizlik kararı üzerine verilen gönderme kararı gibi değildir. Ancak buradaki gönderme kararı da görevsizlik kararı üzerine verilen karar gibi sonuçlar doğurabilmeli- dir. Bu özellikle tahkimde veya mahkemede dava açılmasıyla meydana gelen sonuçların korunması için önem taşımaktadır. Örneğin mahke- mede açılan dava üzerine tahkim ilk itirazı ileri sürülür ve mahkeme bu itirazı kabul ederse, dava açılmasıyla meydana gelen maddi ve usul hu- kukuna ilişkin sonuçlar korunmalıdır. Bu konudaki boşluk Hukuk Mu- hakemeleri Kanunun 20. maddesi kıyasen uygulanarak doldurulmalıdır. Yine zamanaşımı ve hak düşürücü süreler hakkında Borçlar Kanununun 158. maddesindeki ek süreden yararlanılabilmelidir.
Abstract
Objection for arbitration is regulated as preliminary objection in Turkish Code of Civil Procedure as well as in Turkish Act on International Arbitration. Preliminary objection for arbitration is asserted and decided at the beginning of the court proceeding. Before deciding the preliminary objection for arbitration, investigation process cannot be commenced. The purpose of this rule is to prevent delay and uneccessary costs. If preliminary objection for arbitration is accepted, the case will be “dismissed on procedural grounds”. Referring to such dismissal as a decision of “lack of jursidiction” or “rejecting the petition” is not appropriate. Even though it is stated that the judge will order to forward the file when the objection for arbitration is accepted, this is not technically an order to forward the file to the competent court upon the decision of lack of jurisdiction. Yet, the” order to forward the file” in this context should give rise to the results similar to that of the order to forward the file to the competent court upon a decision of lack of jurisdiction. This is especially important to preserve the results, which occur upon bringing an action before a court of arbitration or a civil court. For instance, the results regarding the substantive law and procedural law which occur upon bringing an action before the court should be preserved, when the objection for arbitration is asserted before the court and accepted by the court. Vacuum juris in this matter should be filled by implementing Article 20 of Turkish Code of Civil Procedure by analogy. Moreover, in case of statute of limitations and lapse of time, the additional period of time provided for in Article 158 of Turkish Code of Obligation should apply.
