HMK YARGILAMA MODELİNDE İLKDERECE MAHKEMELERİNDE SÖZLÜ YARGILAMA VE HÜKÜM EVRESİ

Özet
6100 Sy. HMK’da ilkderece mahkemelerinde izlenen yargılama usûlünün inası bakımından, etkin ve verimli bir yargılama temini balamında -özellikle yargılamaların makul sürede tamamlanamaması sorununu çözmek üzere- özgün bir yapı oluturulmutur. Bu açıdan, Yeni Kanun’da teksif ilkesinin, taraf ve mahkeme usûl ilemlerinin belirli yargılama kesitleri içinde ikmalini tazammun eden, katı bir versiyonu benimsenmitir. Yargılamanın final evresinde, mahkeme bakımından, amaç hukuki meselenin halli ve hükmün verilmesidir. Yeni yapısal modelde, HUMK yargılama modelinden farklı olarak sözlü yargılama aamasında tahkikat ilemlerine izin verilmeyerek bu amacın altı çizilmitir. Söz konusu özellik, daha ziyade hukuki meselenin fiili meseleyle sıkı ilikili olduu davalarda ihtiyaç duyulabilecek olan, geriye dönüe izin vermemektedir. Basit usûlde, sözlü yargılama aaması tahkikatı müteakip ayrı bir kesit halinde düzenlenmediinden, final evresine geçi esnektir. Bu özelliin olaan usûl bakımından da benimsenmesi yönünde bir Kanun deiiklii hazırlıı (Adalet Bakanlıı’nca hazırlanan 09.06.2017 Tarihli Kanun Tasarısı Taslaı) mevcuttur. Sözlü yargılamanın tahkikatın hitamını takiben aynı duruma celsesinde gerçekletirilmesi yönündeki deiikliin olaan usûle esneklik kazandırmak için yeterli olup olmayacaı belli deildir. Final evresinde, sözlü yargılama ve hükmün ittihazı için, kullanılabilecek araçlar daha ziyade tarafların aktif olduu hukuki müzakere ve hakimin aktif olduu hüküm hazırlııdır. HMK yargılama modelinde -olaan yargılama usûlünde- tahkikat evresinin hitamını takiben, tarafların sözlü yargılama ve hüküm durumasına davet olunmasıyla, final evresine geçilir. Final evresinde tarafların hukuki meseleye ilikin argümanları sorulup esas hakkındaki mütalaalarının alınmasını takiben hüküm aamasına ulaılır. Hüküm kural olarak sözlü yargılamanın icra edildii celsede verilecektir; ancak, hükmün hazırlanması için, gerektiinde ayrı bir hüküm celsesi tertibi de mümkündür. Basit usûlde, tahkikat durumalarının sonunda, sözlü yargılama için ayrı bir celse günü tayini gerekmeksizin, son beyanlar alınıp hüküm aamasına da geçilerek yargılama sona erdirilebilir. Yargılamanın önceki safhasında iddia-talep vakıası dermeyanı veya ispat zafiyeti halinde, sözlü yargılama kesiti atlanılacaı gibi; kapsamlı bir hüküm hazırlıı da gerekmemekle, hüküm aaması önem arzetmez. htar edilmi olmak kaydıyla, kural olarak tarafların yokluunda hüküm verilebilir. Hükmün gerekçesiyle birlikte tefhim edilmedii hallerde, gerekçeli kararın bir ay içinde yazılması gerekip hükmün taraflara re’sen teblii de zorunludur (HMK, m.310/1). Hükmün gerekçesinin oluturulmasına taraf avukatlarının katkısını da temin bakımından, Hukukumuzda sözlü yargılamanın sözde deil özde icrasına yönelik bir emek ve çabanın gelitirilmesine ihtiyaç vardır. Bunun için, elbette öncelikle ilgili usûl hükümlerinin doru anlaılması ve uygulanması gerekir.
Abstract
In order to provide efficient and productive proceedings, especially to solve the problem of not being able to finalize the proceedings wthin a resonable time period, a structural model specific to our country has been formed in Turkish Civil Procedure Act with regard to first instance judicial proceedings. The new act adopted a rigid version in terms of principle of time limitation. This feature requires the court and parties to make official transactions related to litigation in the definite phases of proceedings. The purpose of the final phase is to render a judgement and to solve the question of law. In the new structural model, this purpose has been emphasized by not giving permission to another transaction. Aforementioned feature does not permit to turn back to the previous phases which are needed to be in hard case; in other words, the case is closely associated with the question of law and the question of fact. In the simplified proceedings, transitions to the final phase is flexible, because oral phase is not designed differantly from the evidentiary phase. At present, there is also a goverment proposal of the act which is about to be accepted about this feature in the ordinary proceedings. Sufficiency of the proposal is ambiguous with respect to the flexibility of ordinary proceedings. Instrument to be used as to final phase’s purpose is a negotiation which is about the question of law in which parties are more active than the judge and preparations of judgement. In the ordinary track, the final phase begins after the parties have been summoned for hearing of oral argument and rendition of judgement. In the simplified track, beginning the final phase is easy, because oral argument is not regulated as a separate hearing. In the oral argument, parties are asked for their arguments about question of law and their opinions are taken pertaining to merit of litigation and then passed to stage of rendition of judgement. Generally, the judgement is rendered in the oral argument of hearing. However, it is possible to set a hearing of judgement as needed, in order to prepare the judgement. In the simplified track, it is possible to bring the proceedings to an end, without setting a separate day for the oral argument in the end of evidentiary phase. Here, final explanations can be taken from parties and then passed on to the stage of rendition of judgement. When there is lack of proof and putting forward facts of allegation in the phases before, in addition to disregard the stage of oral argument, this is not important for the stage of judgement because extensive preparation of judgement is not necessary. In conditions in which parties have been warned before, it is possible to render the judgement in their absence, as a rule. When the judgement is pronounced with the reason for legal and factual grounds, it is essential to write it within a month and the judgement has to be noticed to the parties ex officio. There is a necessity to develope some effort and labor to forward to the oral argument not supposedly but genuinely, in order to provide the contributions of lawyers to judgement with reasons for legal and facual grounds. Fort this reason, the procedural rules surely needs to be understood and applicated correctly.
