Özet

7036 sayılı İş Mahkemeleri Kanunu (“İş Mahkemeleri Kanunu”) ile iş yargısında arabuluculuk kural olarak dava şartı olarak düzenlenmiştir. Buna göre dava açılmadan önce arabulucuya gitmek zorunlu, fakat tarafların arabulucuda anlaşmaları zorunlu değildir. Arabuluculuk faaliyeti sonunda tarafların uyuşmazlık konusunda anlaşmaya varamamaları halinde uyuşmazlığın mahkemeye götürülmesine herhangi bir engel bulunmamaktadır. Getirilen düzenlemede bazı belirsizliklerin söz konusu olması nedeniyle, bu çalışmada dava şartı arabuluculuğa ilişkin uygulamada karşılaşılan ve karşılaşılması muhtemel sorunlara yer verilecektir.

Abstract

With the Act No. 7036 Regarding Code of Labour Courts No. 7036 (“Code of Labour Courts”) mediation before lawsuit arises from labor contract is regulated as mandatory and condition precedent. Accordingly, it is mandatory to apply a mediator to solve the dispute before the lawsuit is filed before labor court, even though the parties do not make a mediation agreement and agree in the mediator. In case the parties cannot solve the dispute with the mediation procedure, there won’t be no obstacle to bringing the dispute to the court. Since there are some uncertainties in the regulations, this study will examine the problems encountered and likely to be encountered in practice regarding mediation as a condition precedent.
