Özet
Suç işleyen bireylerin, suç yerlerinde bedenlerine ait izler bırakmaları normal ve beklenen bir durumdur. Bu izler yargılama süreci için büyük önem taşımaktadır. Delil olarak kullanılabilecek bu izler ve verilerden hukuk dünyasının vazgeçmesi düşünülemez. Günümüzde hukuk sistemleri insan bedeni aracılığıyla ortaya çıkan verilerden delil olarak faydalanmaktadır. Ancak bedenden elde edilen iz ve deliller beden muayenesini gerektirebilmektedir. Beden muayenesi kişi özgürlükleri ile doğrudan bağlantılıdır. Avrupa Biotıp Sözleşmesi beden muayenesi için rıza koşulunu aramaktadır. Anayasamız gereği Biotıp Sözleşmesi üst norm niteliği taşımaktadır. Biotıp Sözleşmesi'nin beden muayenesi için rıza koşulunu arayan düzenlemesi ile Ceza Muhakemesi Kanunu düzenlemelerinin çatışıp çatışmadığı bu çalışmada tartışılmakta ve çatışma bulunmadığı sonucuna ulaşılmaktadır.
Abstract
It is normal and expected situation that the offenders leave traces of their bodies at crime locations.These tracks are of great importance for the process.It is unthinkable, that the world of law to dispense with these tracks and data, which can be used as evidence.Nowadays legal systems profit from the data, that was produced by the human body.Only from the body obtained tracks and evidences require physical examina-tion.Physical examination is directly linked to the liberty of individuals. European Convention on Biomedicine demands consent requirement for pysical examination.European Convention on Biomedicine requires con-sent for the body examination. According to our Constitution, the Bio-medicine Convention is of the highest quality standards.In this study it is discussed, if the regulations of the Biomedicine Convention for the body consent requirement are inconsistent with the regulations of the criminal procedure laws and it is concluded that there is no conflict.
