Özet
Evliliğin boşanma ile sona ermesi durumunda çocuğun velâyetinin ana ve babadan yalnızca birine bırakılacağına ilişkin yerleşik uygulama Yargıtay'ın 2017 yılında verdiği bir karar ile yön değiştirmiş ve o tarih itibariyle çocuğun velâyetinin boşanan ana ve baba tarafından birlikte kullanılabilmesinin önü açılmıştır. Anılan kararda, pek çok Avrupa Birliği ülkesinde yasal yeri bulunan ancak Türk hukuk uygulamasına bu şekilde dâhil olan "ortak velâyet" düzenlenmesinin "Türk kamu düzenine ‘açıkça’ aykırı olduğunu ya da Türk toplumunun temel yapısı ve temel çıkarlarını ihlal ettiğini” söylemenin mümkün olmadığı ifade edilmiş, “eşlerin evlilik bakımından, evlilik süresince ve evliliğin bitmesi halinde, kendi aralarındaki ve çocukları ile olan ilişkilerinde, özel hukuk niteliği taşıyan hak ve sorumluklar açısından eşit oldukları” yönündeki Ek 7 No.lu Protokol’ün 5'inci maddesine vurgu yapılmıştır. Bu çalışmada özellikle boşanma sonrasında ortak velâyetin ana ve baba tarafından yürütülebilmesine ilişkin mevcut ulusal ve uluslararası hukukî düzenlemeler ile doktrinel öneriler, öncül belli başlı Yargıtay uygulamaları doğrultusunda genel hatlarıyla incelenecektir.
Abstract
The widely application that the custody of the child will be left to only one of the parents if the marriage ends with divorce changed with a decision of the Turkish Supreme Court in 2017. As of this date, the custody of the child can be used by the divorced mother and father together in Turkish Law practice. The Decision stated that it was not possible to say that joint custody was clearly contrary to the Turkish public order or that it violated the basic structure and basic interests of the Turkish society. The same decision emphasized Article 5 of Protocol No. 7, which states that the spouses are equal in terms of rights and responsibilities of private law in terms of marriage, during marriage and in the event of marriage. In this study, the current national and international legal arrangements and doctrinal proposals regarding the execution of joint custody by the parents after the divorce will be examined in general terms in line with the main certain Supreme Court practices.
