Özet

Bu çalışmada 5237 sayılı TCKnın Yedinci Bölümünde Devlet Sırlarına Karşı Suçlar ve Casusluk başlığı altında 328. maddede dü- zenlenmiş olan Devletin Güvenliğine ve Siyasal Yararlarına İlişkin Bilgileri Casusluk Maksadıyla Temin Etme Suçu incelenmiştir. Suçun kanunda sistematik yeri itibarıyla, öncelikle devlete karşı suçlar hakkında kısa bir açıklamada bulunulmuştur. Çalışmada bu suçun maddi unsurları ve manevi unsuru, maddede yer verilen kavramlar izah edilmiş, ardından suçun özel görünüş şekillerine yer verilmiştir. Ayrıca inceleme konumuzu oluşturan suç açısından büyük önem arz eden devlet sırrı kavramının içeriği ortaya konulmaya çalışılmıştır. Son olarak da maddenin düzenlenişi ceza tekniği ve uygulamada yarattığı sorunlar ele alınmıştır.

Abstract

In this study, The Crıme Of Obtaınıng Informatıon Related To The Securıty And Polıtıcal Benefıts Of The State Wıth The Purpose Of Espıonage", which is regulated in the article 328 of the Turkish Criminal Code TCC. No 5237 and in the 7th section of the TCC under the heading of "Crimes against state secrets and espionage", is examined. Firstly, crimes against the state is briefly explained because of the systematic place of the crime in TCC. Further, material and moral elements of the offense and concepts related to the offense are explained, afterwards, particular aspects of the offense is evaluated. In addition, since it has great importance in terms of the explained crime, the concept of state secret is analysed. Finally, the arrangement of the article with regard to the crime technique and the problems stemming from its implementation are discussed.
