Özet
Trafik sicilinde kayıtlı motorlu taşıtlar ile taşınmaz satışları resmî şekle tâbidir. Bu resmî şekle noterler ve Tapu Kanunu m. 26 hükmünce görevli tapu sicil müdürlükleri vücut verir. Ancak uygulamada hukukî işlemi yapan taraflar irade beyan etmedikleri halde, matbu olarak sözleşmeye bedeli nakden ve peşin aldım şeklinde ibareler eklenmektedir. Söz konusu memurların kendi görev alanlarına girmeyen bir konuda gösterdikleri bu çaba birçok sıkıntıyı da beraberinde getirir. Paranın ödenip ödenmediğinin resmî şeklin içeriğinde esaslı nokta olarak yer alması gerekli değildir. Buna rağmen resmî senetlerde bedeli nakden ve peşin aldım şeklindeki kayıtlara yer verilmesi sonucunda, söz konusu resmî senetler paranın satıcıya ödendiğine dair kesin bir delil oluşturmaktadır. Bu makalede söz konusu kayıtların ne gibi sorunlar doğurdu- ğuna dikkat çekilmek istenmiştir.
Abstract
The sale of motor vehicles registered to the traffic registry and the sale of immovable properties can only be valid if contracts relating to the sale property are dependent on offıcial form. Notaries or officers of authorised real estate registration offices authenticate such official form in accordance with article 26 of Deed Law. On the other hand in practice, despite the fact that parties of contracts do not declare any intention, contracts include clauses such as I received the consideration in cash. This type of lack competence attempt which are draw up by both notaries and officers can cause many problematic situations. Clauses indicating the consideration has been received by the seller is not compulsory, and do not constitute an essential component of official form. It is, however, considered to be conclusive evidence when clauses such as I received the consideration in cash. are taken place in authenticated deeds. This article highlights such clauses and related issues.
