Özet

Avrupa Birliğinin kurumsal yapısı ve işleyişi bakımından köklü değişiklikler getiren Lizbon Antlaşması, subsidiarite ilkesine ilişkin olarak da bazı yenilikler öngörmüştür. Üye devletlerin ulusal parlamentolarına subsidiarite ilkesinin uygulanmasını denetleme olanağı sağlayan subsidiarite şikâyeti ve subsidiarite davası bu bağlamda öngörülen en önemli yeniliklerdir. Bu iki denetim mekanizmasını ayrıntılı bir biçimde ele almayı amaçlayan bu çalışmada, öncelikle subsidiarite ilkesine iliş- kin genel açıklamalara yer verilecektir. Bunun devamında, subsidiarite şikâyeti ve subsidiarite davası konusu detaylı olarak incelenecektir. Bu iki mekanizma ile gerçekleştirilecek denetimin kapsamının ortaya konmasından sonra, çalışmamız bir sonuç bölümü ile sonlanacaktır.

Abstract

Lisbon treaty, bringing fundamental changes in terms of the institutional structure and the function of European Union, stipulates some changes regarding the principle of subsidiarity. Ensuring the national parliaments of the member states the necessary opportunity to supervise the implementation of subsidiarity principle, the process of subsidiarity complaint and the subsidiarity case are the most substantial changes in this regard. This study has the aim to make expressions regarding the two aforementioned supervision mechanism in details and general remarks in terms of subsidiarity principle is going to be mentioned initially. Afterwards, it is our intention to refer to these two mechanisms in depth. Having been suggested the scope of the supervision with these mechanisms, we would like to draw some conclusions.
