TÜZEL KİŞİLERİN TÜKETİCİ NİTELİĞİ

Özet

6502 sayılı TKHK m. 3/k uyarınca, tüketici, ticari veya mesleki olmayan amaçlarla hareket eden gerçek veya tüzel kişi olarak tanımla- nır. Bu düzenleme, gerçek kişiler bakımından bir sorun teşkil etmese de, ayırım yapılmaksızın tüm tüzel kişilerin tüketici sayılıp sayılmadığı hu- susunun tespit edilmesini gerektirir. Özellikle öğretide ve mahkeme ka- rarlarında, farklı tüzel kişi türleri incelendiğinde farklı yaklaşımlar ol- duğu görülür. Bu nedenle, farklı tüzel kişi türlerinin, tüketici niteliğine sahip olup olmadığı bu çalışmada inceleme konusu yapılmıştır.

Abstract

According to the Law on Consumer Protection numbered 6502, consumer means any natural or legal person who is acting f or purposes which are not related to his trade or prof ession. Even though this regulation does not constitute an issue f or natural person, whether the all types of legal person have the consumer character or not, must be determined without a discrimintion. When the several types of legal person are analyzed, it has been seen that there are varied approaches in the doctrine and the Supreme Court decisions. Theref ore, whether or not the several types of legal person have the consumer character is the subj ect of this study.
