Özet

İrtifak hakları, bir taşınmaz üzerinde diğer bir taşınmaz lehine tapu siciline tescil edilmek suretiyle kurulmuş bir ayni haktır. Bir taşınmaz üzerinde irtifak hakkı kurulması halinde bu hak, malikin mülkiyet hakkını bir ölçüde sınırlamakla birlikte, kural olarak tamamen kullanımını ortadan kaldırmayacaktır. İrtifak hakkının kurulduğu zaman mevcut olmayan çeşitli şartların gerektirmesi halinde yüklü taşınmaz malikine, hakkın değişen koşullara uyarlanması için bazı yetkiler tanınmıştır. Bunlardan biri de MK md. 791'e göre irtifakın kurulduğu yerin değiştirilmesini talep yetkisidir. Yüklü taşınmaz maliki, taşınmazın belli bir kısmında bulunan irtifakın uygun başka bir yere nakledilmesiyle, arazisinden daha fazla yarar elde etme imkanına sahip olacaktır. Lehine irtifak hakkı kurulan malik, bu talebi kabul ettiğinde anlaşmayla, kabul etmezse mahkeme kararı ile değişiklik gerçekleştirilecektir. Değişiklikle birlikte çoğu zaman irtifak hakkının terkin edilerek sona ermesinin önüne geçilerek, hakkın devamlılığı sağlanabilecektir.

Abstract

Easement rights are a kind of right in rem that can be established by registering the encumbrance in favor of a real estate. Although establishing an easement on a property restricts the rights of owner considerably, it does not completely remove the right to use it as a rule. The owner of the encumbered property is entitled to claim adjustment of the easement to changing conditions if unforseeable circumstances at the time of establishing easement deem it necessary. One of these options is the right to claim relocation of the encumbrance in accordance with Article 791 of the Turkish Civil Code. The owner of the encumbered property can request relocation of the encumbrance to another available place so that he/she will be able to gain more profit from his/her real estate. If the beneficial owner of the easement agrees with the claim, the relocation will be established by the agreement of the parties, otherwise, the relocation will be provided by a court decision. By means of the adjustment procedure, generally the termination of the easement right by the deletion will be prevented and the maintenance of the right will be provided.
