Özet
Hukuka uygunluk nedenlerinin koşullarında hata, suç teorisinin en tartışmalı konularından biri olup, bu konuda çok farklı görüşler ileri sürülmüştür. Bu çalışmada söz konusu hataya ilişkin teorik tartışmalar üzerinde durulduktan sonra, Türk Ceza Hukuku bakımından olan ve olması gereken hukuk açısından eleştiri ve önerilerde bulunulacaktır.
Abstract
Mistake about the conditions of justification is one of the most contested themes in the crime theory and there is a wide range of views on this issue. This article will examine the Turkish Criminal Law from a de lege lata and de lege ferenda point of view after an explanation of the theoretical discussions on the mistake about the conditions of justification.
