Özet

Davaya son veren taraf işlemlerinden davayı kabul ile 6100 sayılı Hukuk Muhakemeleri Kanunu’nda İspat ve Deliller kısmında düzenle- nen ikrar kurumu birbirine benzemesine rağmen; bu kurumlar, nitelikleri ve sonuçları açısından birçok farklılığı bünyesinde barındırmaktadır. Uygulama ve doktrinde davayı kabulün, ikrar teşkil edip etmeyeceği hususunda görüş ayrılığı mevcuttur. Bu görüş ayrılığının sebebi esas itibari ile her iki kurumun da taraf işlemi olması, hâkimin onayına veya karşı tarafın muvafakatine ihtiyaç olmadan usuli etki doğurması ve her iki usuli işlemde de vakıalardan çıkan sonucun inkârı yerine, bu sonuca rıza gösterilmesidir. Ancak, hukuki nitelikleri açısından bakıldığında davayı kabul, çifte karaktere sahip yani hem maddi hukuka hem de usul hukukuna ilişkin özellikleri bünyesinde barındırmasına rağmen; ikrar, salt bir usuli işlemdir. Davayı kabulün, ikrar teşkil ettiği kabul edilirse, bu duruma birçok hukuki sonuç bağlanacaktır. “Davayı kabul ikrar teşkil eder mi?” sorusuna cevap verebilmek için; davayı kabul ve ikrar kurum- larının hukuki niteliklerinin, meydana geliş şekillerinin, bu kurumlara bağlanan hukuki sonuçların tereddüde yer vermeden ortaya konulması ve her iki kurumun kıyaslanması gerekmektedir. Aksi takdirde makale- mizde cevabını aradığımız sorunun cevabı hep muğlak kalacak, hukuk kuralları kişilere eşit olarak uygulanmayacaktır. Çalışmamızda davayı kabul ve ikrar kurumunun tanımı, unsurları, hukuki niteliği, türleri ve bu kurumlara bağlanan sonuçlar detaylıca incelenmiş; davayı kabulün ikrar teşkil etmeyeceği karşılaştırmalı yöntem ile ortaya koyulmuştur.

Abstract

In spite of the acceptance of the case of the defendant out of the proceedings from the parties that put an end to a case and the admission regime what is regulated in the part ‘‘The Evidences and Depositions’’ of The Code of Civil Procedure (CCP) No: 6100 are resembled; afore- mentioned regimes include many differences in terms of their attributes and results. There is a visibility about, whether the acceptance of the case of the defendant constitutes an admission on doctrine and practise. The mainspring of the aforementioned visibility are both regimes are the proceedings of the parties, provide procedural results devoid of an app- roval of the judge or a consent of the other party and instead of disclai- ming the result, approving it. Nevertheless, there is a difference in their legal attribution. Despite the acceptance of the case of the defendant includes the attributes related to both factual and procedural law; the admission is a simple procedural proceeding. If the acceptance of the case of the defendant is accepted to be an admission, many legal con- sequences will be attached in it. The legal attributions, the forms about how do they occur and the legal consequences of these aforementioned regimes must be propounded with no hesitation in order to answer the question ‘‘Does acceptance of the case of the defendant constitute an admission ?’’ and compared. Otherwise the question, which we are se- arching for an answer, will be wholly obscure and the rules of law will not apply equally to persons. In this article; the definition, elements, legal attribution, types of the acceptance of the case of the defendant and admission regimes and the consequences which are attached to afo- rementioned regimes are investigated and the acceptance of the case of the defendant is presented by comparative method that it does not cons- titute an admission.
