MİLLETLERARASI TAHKİMDE DAVADAN MEN TEDBİRLERİ

Özet

Bu çalışmada uzun süredir tartışılagelen konulardan biri olan da- vadan men tedbirleri (antisuit injunctions) incelenmektedir. Bu tedbirin gelişimi irdelenecek, ardından gerek Anglo-Sakson hukuk sistemine gerek Kıta Avrupası hukuk sistemine dâhil ülkelerdeki uygulamalardan örnekler verilecektir. Konunun özel bir öneme sahip olduğu Avrupa Bir- liği hukukundaki ilgili düzenlemelere de çalışmamızda yer verilecektir. Son olarak, Türk mahkemelerinin milletlerarası tahkime ilişkin davadan men kararı verme yetkisinin olup olmadığı, bu konuda uygulamanın na- sıl olduğu ve bu tedbirlerin Türkiye’deki uygulama açısından gerekli olup olmadığı irdelenecektir.

Abstract

This study examines a long disputed issue: antisuit injunctions. Development of the concept of antisuit injunction is examined in this study; moreover, examples from both Anglo-Saxon legal systems and civil law legal systems are also provided. European Union legal system for which antisuit injunctions are of great significance is also included in the study. Lastly, whether Turkish courts have the power to render antisuit injunctions related to international arbitration, the current prac- tice on this issue, and whether antisuit injunctions are necessary under Turkish law are examined.
