Özet

Geçtiğimiz yüzyıl sonunda hayatımıza giren İnternet hukuk kural- larında ciddi bir değişimi beraberinde getirdi. Bu yeni olgunun insan hakları hukukunda ortaya çıkardığı yeni kavramlardan birisi de unutulma hakkı oldu. Unutulma hakkı biçiminde yeni bir hakkın ortaya çıkma ne- deni İnternetin muazzam bir bilgi kaynağı haline gelmesi ve bilgiye üc- retsiz veya düşük bir maliyetle kitlesel olarak erişimi mümkün kılması- dır. İnsanlık tarihi boyunca üretilmiş bilginin belki de birkaç yıl içinde üretilebildiği günümüzde, geçmişte yalnızca devlet tarafından ulaşılabi- len ve hatta devlet tarafından bile ulaşılmayan bilgiler gerçek kişiler ve özel hukuk tüzel kişilerince rahatlıkla ve hızlı bir şekilde ulaşılabilir hale gelmiştir. Bu nedenle henüz herhangi bir bağlayıcı uluslararası belgede kendisine açıkça yer bulmasa da, dijital ortamda unutulma hakkı İnternet çağının doğurduğu önemli haklardan birisi haline gelmiştir. Elbette her yeni kavram gibi bu kavramın kapsamı da henüz belirsizliğini korumak- tadır. Bu çalışma unutulma hakkı kavramı, unsurları ve ifade özgürlüğü ile özel yaşama saygı hakkı arasında doğurduğu gerilime ilişkin bir baş- langıç niteliğinde düşünülmelidir.

Abstract

The Internet has entered our lives at the end of the last century and brought a serious change in the field of law. One of the new concepts that this new phenomenon emerged in human rights law was right to be forgotten. The reason for the emergence of such a new right as right to be forgotten is that the Internet becomes a tremendous source of infor- mation and makes it possible a massive access to information with no cost or affordable cost. Today we can produce a vast amount of infor- mation in such a short time which perhaps has not been produced throughout the human history and information which has been only ac- cessible by the state or even has not been accessible by the state previ- ously is easily and quickly be accessible by real persons or legal entities of private law. That being the case, although there exists no binding in- ternational document that explicitly set forth a right to be forgotten in digital media yet, it has become one of the most substantial right in digi- tal media that the age of Internet created. For sure, as with every new concept, the scope of the fledgling right remains unclear. This study should be considered as an introduction regarding the concept and ele- ments of right to be forgotten and the tension between the freedom of expression and the right to respect for private life.
