Özet

Üst düzey kamu görevlilerini belirleme gücüne sahip olmayan bir iktidarın ülke yönetiminde muktedir olması düşünülemeyecektir. Zira üst düzey kamu görevlilerinin varlığı, bir iktidarın idari ve siyasi gücünün temellerini oluşturmaktadır. Seçimler ile türlü badireleri atlatarak yönetime gelen iktidarın seçmenlere vermiş olduğu sözleri tutabilmesi, uyum içerisinde çalışabileceği bir ekibi kurmasına bağlıdır. Tarihten günümüze kadar gelmiş olan, seçimleri kazananın tüm bürokrasiye hâkim olacağı anlayışını temsil eden “yağma ve ganimet sistemleri”, liberal anayasacılık felsefesinde artık benimsenmemektedir. Bu sebeple, liyakat ve çoğulculuğu temel alan yeni atama sistemlerinin kurgulanması ihtiyacı ortaya çıkmıştır. Günümüzde üst düzey kamu görevlilerinin atanmasında, atamayı yapma veya atamaları onaylama makamının yürütme dışından bir merci olması fikrinin hızla yayılmaya başladığı görülmektedir. Bu mercilerin başında yasama organı bulunmaktadır. Bu sayede yasama organı yürütmeyi; dolaylı olarak parlamento içi muhalefet siyasi iktidarı dengeleyebilecektir. Ayrıca tek bir sesi temsil eden iktidar yerine, parlamento içi muhalefetin de içinde olduğu ve toplumun tüm kesimlerinin kendine yer bulabildiği meclislerin sürece dâhil olması ile daha kapsayıcı bir bürokratik yapı kurgulanmış olabilecektir. Ancak bunun için meclislerin atanmasında rol oynayabildiği üst düzey kamu görevlilerinin sayısı artırılmalıdır. Buna ilaveten, yürütmenin yasamaya genellikle sayısal olarak hâkim olmasının bürokrat atamaları üzerinde doğuracağı olumsuzlukların çeşitli araçlar ile asgariye indirilmesi gerekmektedir.

Abstract

It seems inconceivable that any government in power deprived of the authority to designate senior public officials would be capable enough to govern the country, simply because existence of senior public officials constitutes the basic pillars ofadministrative and political power of a government. For a government, which has risen up to power after having overcome multiple hurdles, to keep its promises and pledges towards its voters actually depends on formation of a team with whom it can work in harmony. Liberal constitutional philosophy no longer upholds ‘plunder and spoils systems’ which represents, from the past to present, the mainstream idea that whoever wins the elections will dominate the whole bureaucracy. This has aroused the need to conceive and design new appointment systems based on merits and plurality. The idea, that the authority which would be in charge of making or approving appointments of senior public officials must be outside the executive body, has been rapidly and widely disseminated. Primary example of non-executive authorities would be assemblies. This would pave the way for balancing the executive body with the legislative body and, likewise, indirectly balancing the political power with the parliamentary opposition. Thus, through participation and accompaniment of the assemblies which embrace all segments of society and allow for parliamentary opposition, a more inclusive bureaucratic structure will be able to be designed contrary to the single-voice ofgovernment. To realise this, the number ofsenior public officials in whose appointments the assemblies can play a role must be increased. Additionally, the inconveniences usually arising from numerical domination of the executive over the legislative which afflict the appointment of bureaucrats are required to be minimised through various means.
