SÖZLEŞMELİ ÖĞRETMEN ATAMA SÜRECİNDE YAPILAN SÖZLÜ SINAV VE GÜVENLİK SORUŞTURMALARININ İDARE HUKUKU AÇISINDAN DEĞERLENDİRİLMESİ

Özet
Sözleşmeli personelin Anayasa’nın 128. maddesinde yer alan “diğer kamu görevlileri” kapsamında yer aldığı, gerek doktrinde gerekse yargı kararlarında büyük ölçüde kabul edilmektedir. Sözleşmeli personel istihdamının en yaygın görüldüğü kurumlardan biri de Milli Eğitim Bakanlığıdır. Milli Eğitim Bakanlığı, 2016 yılında mevzuatta yapılan değişikliklerin ardından her yıl on binlerce sözleşmeli öğretmen alımı yapmaktadır. Sözleşmeli Öğretmen İstihdamına İlişkin Yönetmelik’te belirlenen usul ve esaslar çerçevesinde işletilen sözleşmeli öğretmen alım sürecinin en önemli ayağını sözlü sınavlar oluşturmaktadır. Sözlü sınavlarda adayların branşlarına ilişkin bilgi düzeyi ölçüldüğü gibi öğretmenlik mesleğinin layıkıyla icra edilmesini sağlayacak kişisel özellikleri de değerlendirilir. Bu değerlendirmeler sonucunda adayın sözlü sınavdan başarılı sayılıp sözleşmeli öğretmen olarak atanmak üzere tercih hakkı kazanması mümkün olduğu gibi sözlü sınavdan başarısız sayılarak kamu hizmetine girmesi engellenebilir. Mevzuat değişikliği sonucu Devlet memurluğuna girişte aranan genel şatlardan biri haline gelen güvenlik soruşturmaları sonucunda ilgililerin hukuki durumuna etki eden işlemler tesis edilmektedir. Uygulamada bu etki, sözleşmeli öğretmen atama sürecinde yapılan güvenlik soruşturmalarının idare tarafından adayın sözlü sınavdan başarısız sayılmasına gerekçe gösterilmesi şeklinde ortaya çıkmaktadır. Bu durum, hukuk devletinden sapma anlamına geleceği gibi idarenin kanuniliği ilkesi açısından da hukuka aykırılık teşkil eder.
Abstract
In the doctrine and judicial decisions, it is widely accepted that contractual personnel are included in the “other public officials" contained in Article 128 ofthe Constitution. One ofthe institutions where the employment ofcontractual personnel is the most common is the Ministry of National Education. The Ministry ofNational Education employs tens of thousands of contractual teachers each year following the amendments to the legislation in 2016. Oral exams are the most important pillar of the contractual teacher recruitment process, which is operated in accordance with the procedures and principles determined in the Regulation on Contractual Teacher Employment. In oral exams, the level of knowledge about the branches ofcandidates is measured as well as their personal characteristics which will ensure the proper execution of the teaching profession. As a result ofthese evaluations, the candidate may be assumed as successful in the oral exam and acquire the right ofchoise to be appointed as a contractual teacher or he/she may be considered unsuccessful and prevented from admission to public service. As a result of the security investigations, which have become one of the general requirements for admission to the civil service as a result ofthe amendment of the legislation, transactions affecting the legal status of the persons concerned are established. In practice, this effect emerges as the security investigations made during the process of contract teacher assignment have been given as a reason by the administration for the candidate to fail the oral examination. This situation is mean a deviation from the rule of law, as well as constitutes a violation ofthe law in terms of the the principle of legality of administration.
