KONKORDATONUN İŞ SÖZLEŞMELERİNE ETKİSİ

Özet

Konkordato, bir borçlunun belli bir zaman dilimi içerisindeki tüm adi borçlarını, öngörülen nitelikli çoğunlukla alacaklıları tarafından ka- bul edilmiş ve yetkili makamlarca onaylanmış olan teklifi doğrultusunda ve kendisi için elverişli koşullar çerçevesinde ödemesini mümkün kılan bir hukuksal kurumdur. 1 Konkordato iflasın ve tasfiyenin alternatifi ola- rak borçluya ayakta kalma, yaşama olanağı vermektedir. 2 Hukukumuz- dan iflasın ertelenmesi müessesesinin kaldırılması ile birlikte konkorda- tonun önemi artmış ve günümüzde birçok işveren, büyük firmalar dahi konkordatoya başvurur hale gelmişlerdir. Konkordato ilan eden işyerle- rindeki işçilerin alacakları ve işçi ile işveren arasında yapılan iş sözleş- melerinin akıbeti de Türkiye’de çalışan kesimin büyük çoğunluğunun işçi olduğu göz önünde bulundurulduğunda değerlendirilmesi gereken önemli bir konudur.

Abstract

Bankrupt's certificate concept is a legal institution that allows a debtor to pay all his ordinary debts within a certain period of time, in accordance with his proposal approved by the qualified creditors and approved by the competent authorities and payable under the favorable conditions for himself. As an alternative to bankruptcy and liquidation, Bankrupt's certificate concept gives the debtor the opportunity to sur- vive. With the abolition of postponement of bankruptcy from our law, the importance of concordantity has increased and many employers and big firms have come to apply to concordat. Bankrupt's certificate concept is an important issue that should be considered when declared by the workers in workplaces and workers take the fate of their employment contracts made between the employer that the workers taken into con- sideration the vast majority of the working population in Turkey.
