Özet

Bir suç soruşturması çerçevesinde şirket yönetimine kayyım atanması bir koruma tedbiri olarak 5271 sayılı Ceza Muhakemesi Kanunu ile Türk Hukuku’na girmiştir. CMK’nın 133. maddesinde düzenlenen bu tedbire başvurulabilmesi için oldukça sıkı koşullar öngörülmüştür. Çalışmada tedbir, ayrıntılarıyla incelenecektir.

Abstract

Appointing a trustee to a company in the framework of a criminal investigation has entered to Turkish criminal procedure law with 5271 numbered Criminal Procedure Code as a protection measure. The measures forseen for applying this measure are very strict. In this study, the measure will be examined in detail.
