Özet
İcra ve İflas Kanunu’nun 82/1 b.12 maddesinde borçlunun hâline münasip evi, haczedilemeyecek mallar arasında sayılmıştır. Borçlunun ailesiyle birlikte yaşadığı hâline münasip evin haczedilmesi durumunda, bu işleme karşı kimlerin şikâyet başvurusunda bulunabileceği hususunda doktrin ile Yargıtay kararları arasında farklılık bulunmaktadır. Doktrinde, bu işleme karşı icra takibinin tarafı olmamasına ve taşınmazın adına kayıtlı bulunmamasına rağmen, borçlunun eşinin de şikâyet başvurusunda bulunabileceği kabul edilmektedir. Buna karşın Yargıtay, haczedilemezlik şikâyetini yalnızca icra takibinin tarafı olan borçlunun ileri sürebileceğini, borçlunun eşinin şikâyet başvurusunda bulunamayacağına karar vermektedir. Anayasa Mahkemesi de 2016/10454 sayı ve 12.12.2019 tarihli kararında, haczedilemezlik şikâyetinin borçlunun eşi tarafından ileri sürülemeyeceğine ilişkin mahkeme kararlarının Anayasa’nın 20 ve 41. maddelerinde düzenlenen “aile yaşamına saygı hakkı”nı ihlâl edip etmediğini tartışmıştır. Söz konusu kararda Mahkeme, borçlunun eşinin şikâyet hakkından yoksun bırakılmasının, aile yaşamına saygı hakkının ihlâli anlamına geleceğine oy çokluğu ile karar vermiştir. Makalede, Anayasa Mahkemesi’nin kararında dayandığı gerekçeler ile karşı oyda ileri sürülen görüşler İcra Hukuku ile temel hak ve özgürlüklerin ilişkisi çerçevesinde değerlendirilmektedir.
Abstract
In accordance with the Article 82/1 b.12 of the Enforcement and Bankruptcy Law, a debtor's house that is compliant with his financial status is listed among the non-foreclosure properties. The doctrine states that the debtor's spouse may also file a complaint against this procedure although she is not a party to the execution proceedings and the real estate is not registered in her name. On the other hand, the Supreme Court of Appeals rules that only the debtor, who is a party to the enforcement proceedings, may file a complaint for non-foreclosure properties and the debtor's spouse may not file a complaint in this regard. In its decision numbered 2016/10454 and dated 12/12/2019, the Constitutional Court discussed whether court decisions concerning that the debtor's spouse may not file a complaint for non-foreclosure of properties violate the “right to respect for family life” regulated in Articles 20 and 41 of the Constitutional Law. In the article, the justifications on which the Constitutional Court's decision is based and the opinions put forward by the opposing voters were evaluated.
