Özet

Telekomünikasyon yoluyla yapılan iletişimin denetlenmesi, araya bir vasıta sokulmak suretiyle gerçekleştirilen her türlü haberleşmenin gizlice dinlenmesi, buradan elde edilen bilgilerin kaydedilmesi ve değerlendirilmesini kapsamına almakta olup, haberleşme özgürlüğüne ve aynı zamanda da genel kişilik haklarına müdahale oluşturmaktadır. Avrupa İnsan Hakları Sözleşmesinin 8’inci maddesi ile herkes, bireysel yaşamının çeşitli yönleri olan özel hayatı, aile hayatı, haberleşme ve konutu düzeyinde koruma altına alınmıştır. Maddede yer alan haberleşme hakkı, bireylerin engellenmeksizin ve sansür edilmeksizin diğer insanlarla iletişim kurma hukuksal çıkarını güvence altına almaktadır. Haberleşmenin gizliliğine saygı gösterilmesi hukuksal çıkarı da bu hak çerçevesinde korunmaktadır. Sözleşmenin bu maddesine paralel hüküm, Anayasanın 22’nci maddesinde yer alan haberleşme hürriyetidir. İletişimin denetlenmesine yönelik ceza hukuku düzenlemesi ise Ceza Muhakemesi Kanununun 135-138’inci maddelerinde yer almakta olup, bu tedbirin nihai amacı da delil araçlarının elde edilmesidir.

Abstract

The monitoring of communication through telecommunications, the eavesdropping of all kinds of Communications conducted by means of interception, the recording and evaluation of the information obtained from here, constitutes an interference to the freedom of communication and also to the rights of general persons. Under Article 8 of the European Convention on Human Rights, everyone is protected at the level of his private life, family life, communication and housing, which are various aspects of his personal life. The right to communication in the article guarantees the legal interest of individuals to communicate with other people without hindrance or censorship. The legal interest of respecting the privacy of communication is also protected within the framework of this right. The provision parallel to this article of the convention is the freedom of communication contained in Article 22 of the Constitution. The criminal law regulation for the supervision of communication is contained in articles 135-138 of the Criminal Procedure Code, and the ultimate aim of this measure is to obtain the means of evidence.
