Özet

Bu çalışmanın amacı; belediye şirketlerinin Kamu İhale Kanunu kapsamındaki statülerinin değerlendirilmesi ve belediye şirketlerinin kamu ihaleleri kapsamında etkinliğini belirlemektir. Çalışmada, konuya ilişkin derleme ve doküman incelemesi yöntemlerinden faydalanılmıştır. Bu kapsamda Kamu ihale Kanununa ilişkin güncel mevzuat incelenmiştir. Çalışmada Kamu İhale Kurumundan temin edilen istatistikler neticesinde çeşitli analizler yapılmıştır. Bu analizler, 2011-2018 yılları arasındaki ihalelerde; toplam kamu alımı, ihaleye katılan toplam kurum sayısı, belediye bütçesinde ihaleye katılanlar, belediye iktisadi teşekküllerinden ihaleye katılanlar ve bu iki oluşumun yaptıkları kamu alımı değerlerinden gerçekleştirilmiştir. Analiz sonuçlarına göre, kamu alımı toplamı içinde belediye bütçesinin payı yüzde 40’lara ulaşmışken, belediye iktisadi teşekküllerinin payı ise yalnızca yüzde 3 dolaylarında kalmıştır ve hizmetlerin belediye şirketleri yoluyla yerine getirilmesinin istenilen düzeyde olmadığı, hizmetlerin hâlâ belediye idaresi tarafından yerine getirilmekte olduğu tespit edilmiştir. Bu noktadan hareketle belediye şirketlerinin kârlılık bakımından etkin olmadığı görülmüştür.

Abstract

The aim of this study is to evaluate the status of municipal companies under the Public Procurement Law and to determine the effectiveness of municipal companies in the scope of public procurement. In the study, the methods of compiling and reviewing documents related to the subject were utilized. In this context, current legislation on the Public Procurement Law was examined. In the study, various analyses were made as a result of the statistics obtained from the Public Procurement Agency. These analyzes were carried out in tenders between 2011-2018; total public procurement, the total number of institutions participating in the tender, those who participated in the tender in the municipal budget, those who participated in the tender and the public procurement values of these two entities. According to the results of the analysis, while the share of the municipal budget in the total public procurement reached 40 percent, the share of the municipal economic organizations remained only around 3 percent and it has been determined that services are not at the desired level to be carried out through municipal companies, and that services are still being carried out by the Municipal Administration. From this point, it has been observed that municipal companies are not effective in terms of profitability.
