Özet
İnsanı merkeze alan çevre düzeni anlayışı, kendilerini insanlar gibi söz, protesto veya hukuki yöntemlerle ifade edemeyen diğer canlılara ve özellikle hissedebilen canlılar olan insan dışı diğer hayvanlara da dokunan sonuçlar doğurmaktadır. Ulusal hukuk sistemlerinde kimi zaman yasa hükümleriyle, kimi zaman mahkeme kararlarıyla insan dışı hayvanların da korunması gereken haklarının olduğu veya insanların onlara karşı davranışlarını düzenleme zorunluluğunun bulunduğu ortaya konmuştur. Uluslararası hukuk açısından insan dışı hayvanların durumu nasıldır? İnsan dışı hayvanların bir uluslararası hukuk süjesi olarak ele alınıp alınamayacağı tartışması, bu canlıların korunması noktasında aşama kaydedilmesi için çok önemlidir. Çalışmada insan dışı hayvanların durumunun nasıl iyileştirileceği sorununun uluslararası hukuk ayağı, sorunun etik tartışmalarına girilmeden, ele alınmıştır. Bu kapsamda çalışmada insan dışı hayvanların uluslararası hukuk süjeliği tartışılmış ve uluslararası hukuk çerçevesinde insan dışı hayvanların nasıl ele alındığı- na değinilmiştir. Çiftçilik Amacıyla Tutulan Hayvanların Korunmasına İlişkin Avrupa Konvansiyonu’na da değinildikten sonra, insan dışı hayvanların korunmasında uluslararası hukukun rolü değerlendirilmiştir.
Abstract
The understanding of the environment, which takes people to the center, has consequences that touch other living creatures that cannot express themselves with words, protest or legal methods as humans but can feel the pain in the same way with them. In national legal systems, it is revealed that sometimes non-human animals have the right to be protected or that people have to manage their behavior with considering them because of the law provisions and because of the court decisions. What is the situation of non-human animals in terms of international law? The debate on whether non-human animals can be treated as an international legal subject is crucial for progress in the protection of these creatures. In the article, the international legal aspect of the question of 'how to improve the condition of non-human animals' is discussed without going through the ethical debates of the problem. In this context, the relation between the international law and non-human animals are discussed and how non-human animals are handled within the framework of international law is mentioned. After evaluating the European Convention on the Protection of Animals Held for Farming, the role of international law in the protection of non-human animals was evaluated.
