Özet
2911 sayılı Toplantı ve Gösteri Yürüyüşleri Kanunu'nun1 29 uncu maddesinde toplantı veya gösteri yürüyüşüne engel olma suçu düzen-lenmiştir. Suçun maddi konusunu, Kanun'a uygun şekilde gerçekleştiri-len toplantı ve gösteri yürüyüşleri oluşturmaktadır. Suçun hukuki konusu ise temel hak ve hürriyetlerin süjesi olan kişilerin toplantı ve gösteri yü-rüyüşü düzenleme özgürlükleridir. Söz konusu suç tipinin yapısal unsur-ları bu çalışma kapsamında ele alınmıştır. Suça ilişkin kanunda öngörü-len yaptırım tür ve miktarı, görevli ve yetkili mahkeme ile soruşturma koşuluna ilişkin tespitlere de ayrıca yer verilmiştir. İfade özgürlüğünün özel bir görünüm şekli olduğu kabul edilen toplantı veya gösteri yürü-yüşlerinin demokratik hukuk devletlerinde kamuoyu oluşturma konu-sundaki etkisi yadsınamaz bir gerçektir. Dolayısı ile söz konusu özgür-lüğün özellikle hukukun belirlediği sınırlar içinde kalması kaydı ile hiç-bir hukuka aykırı müdahaleye veya engellemeye maruz bırakılmadan kullanılmasını sağlamak gerekmektedir. Bu gereklilik aynı zamanda devletler için birer pozitif yükümlük olarak ortaya çıkmaktadır. Bu ça-lışmada, toplantı veya gösteri yürüyüşüne engel olma suçu ceza hukuku teorisi kapsamında incelenmek suretiyle hem öğreti hem de uygulamaya katkı sunmaya çalışılmıştır.
Abstract
In Article 29 of the Law No. 2911 on Meetings and Demonstrati-ons, the crime of preventing meetings and demonstrations is regulated. The matter of fact of crime is the meetings and demonstration which organized in accordance with the law. The legal interest protected by crime is persons's freedom of meetings and demonstrations whom are the owner of fundamental rights and freedoms. The structural elements of the crime in question have been handled within the scope of the study. The subjects such as amount of sanction prescribed by the law, duty and competent court and investigation conditions are also included in this study. The effect of meetings and demonstration marches, which are ac-cepted as a special form of freedom of expression, in forming a public opinion in democratic legal states is an undeniable fact. Therefore, it is necessary to ensure that this freedom is used without being exposed to any illegal intervention or interference, provided that it is within the limits set by the law. This requirement also arises as a positive obliga-tion for states. In this study, it has been tried to contribute to both doct-rine and practice by examining the crime of preventing meetings or de-monstrations within the scope of the general theory of criminal law.
